    Cash and Carry Question

If you purchase a long gun that is over 50 years old from another California resident, can you have it shipped to your door?

Does the transaction have to be face to face? Can one send a copy of the CADL to the seller along with the monies?

Or if being shipped, does it have to go through and FFL?

If it has to go through and FFL, would you be subject to the 10-day wait?

In order fir it to be shipped directly to you, I believe you must have your FFL 03 C&R License, otherwise you have to go through a dealer.

I don't remember when they changed the C&R laws but the days of cash and carry are over now and all C&R must go through an FFL. Not sure why as I've never heard of a C&R guns used in a crime, just stories about people collecting them as a hobby.

Moonshine, this is incorrect. Cash and carry for C&R long guns is in effect for the next twelve and a half months, it goes away January 1, 2014. Shipping through UPS/FedEx/USPS is not cash and carry though.

According to my thread on this topic, a C&R long gun should be ok to ship:

It's legal for a California resident to sell and ship a 50+ year old C&R long gun to another 18+ year old California resident. But many people won't do it because they have no easy way to verify that the buyer is 18+ years old. The buyer might be a 16 year old kid who sent you a photoshopped copy of an ID.

So it is legal to ship a Cash and Carry (50+ year old long gun) to the buyers door?

The risk is, no way to prove the buyer isn't a minor using a fake drivers license?

Another "risk" is that the buyer is an LA Times reporter doing a story on how lax California's gun laws are.

NOT ILLEGAL is the term. Get a copy of California ID, and ship it to that address. I also get a signed statement that the buyer is not prohibited.

This is entirely possible, akin to AIDS from a toilet seat, but possible.

It's important to note that if the seller does NOT have an 03 FFL, there is no requirement to record the buyer's drivers license. It is simply good practice to do so just to cover your end in case the buyer isn't actually 18+.
