It would have been different had they dropped their guns, and taken off. Instead they retained their weapons, and started running. A guy with a gun on the ground could still easily kill you or someone else. They were still in the cafe with weapons running around. Wounded animals can be very dangerous, and so can wounded people.

Every case is different and has to be evaluated based on the circumstances as well as the laws of that particular state.
