    Gun shop sold me (20 y/o) a complete lower, but won't let me take delivery.

    I ordered a complete LMT lower from Discount Gun Mart off Morena in San Diego in early April.

    I was stoked, it had an ambi-safety, which was important for me as a lefty.

    I was told by the employee that I had to be 21 to purchase a stripped lower, but 18 to buy a complete lower.

    I was also told that it would arrive in ~5 weeks.

    TEN WEEKS LATER

    After calling every 2 weeks to request a status update, I finally get a call saying that they have awesome news, and terrible news.

    Awesome news: The LMT lower is in.
    Terrible news: Since I'm not 21, I can't take delivery of if.

    I will be 21 in mid-August.

    They said they don't mind holding it for me until my birthday.

    I asked if I could get a refund, and have my dad purchase it, and perform an intrafamily transfer. They said that they can't knowingly refund to a minor, and sell to an adult parent.

    I also will be fined heavily if I want a refund because it was a special order item.

    So they had no problem taking my money, but when it comes to taking deliver of the receiver, I am not permitted to do so?

    So I just basically wasted 10 weeks of very patient waiting. I would've just purchased an AR off the shelf had I known this situation would ensue.

    So that's where you guys come in.

    What can I do? Who is right? Is my only option waiting it out until my 21st?

    Do you already have your upper? Hell I have an upper, you can borrow my upper bring it in, attach it and get the transfer completed as a rifle.

    Does CalGuns agree this is legal?

      Sadly they were wrong to sell it to you and they certainly can give you a refund. Taking them to small claims court will be to much money and will probably not be resolved before your 21st birthday. As long as you ant paying for a second DROS I would say the shop is being more than fair.

        When did the law change to 21 and over, I thought that was for handguns only?
        Gun control is a 1" group at 500 yds!

          It has always been 21 and over for anything other than a rifle or shotgun. So, AOWs, handguns, "cruisers," and receivers, non-rifle/shotgun long guns (m1919 etc.)

            people over 18 but under 21 can only buy shotguns or rifles. since a complete lower is not yet a rifle (on paper it is a long gun not a rifle or shotgun), a person over 18 but under 21 can not buy a complete lower, stripped lower, a cruiser (shotgun), etc. only fully completed rifles or shotguns

            (To add to the stupidity, if you are over 18 but under 21 you can build any of that legally, you just can not buy it)

              If you have a stock, take that in and have them install it on the lower. Once it has a stock attached it can't be considered or even legally converted to a pistol. Wahlah! It's now a long gun/rifle

                Why can't you bring in an upper and have them put it on? OR were you going to use it as a pistol?

                    I ordered my lefty (Stag 3HL) upper 9 weeks ago (should've been here 6 weeks ago) from a different shop.

                    These laws are so nebulous and ridiculous. A stripped lower at 21 makes sense, but a complete lower doesn't.

                    Edit: The LMT complete lower HAS a stock on it.

                        Nope. it still needs an upper receiver. It is a long gun, it is not yet a rifle or shotgun though.

                            I ordered the upper 9 weeks ago. When I bought it, they said it should be here in 3 weeks.
