    1 in 30 Exemption for COE/C&R

    I recently did a purchase of a modern handgun and mentioned having bought a handgun (not a PPT) not too long ago from dealer stock. So of course the "was it within 30 days?" came up. Told them I wasn't sure, but that I had my COE/C&R with me and they could use that as an exemption. I was told that exemption no longer exists. I had just tossed the CA code documents from the carry case I bring with me, so I couldn't persuade them otherwise. Didn't really try after figuring it had been +30 days.

    Am I correct - the exemption still applies for COE/C&R holders purchasing modern handguns and semi rifles, etc? If anyone has the CA code would appreciate the info.

    (10) Any person who is licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, and has a current certificate of eligibility issued by the Department of Justice pursuant to Article 1 (commencing with Section 26700) of Chapter 2.

      Thanks very much. I used to carry a printout with me back in the dark days of "what's a C&R?" but stopped recently. Most of my usual stops know the exemption and I've bought enough from them that I can have a little back and forth. But, new store and I hesitate to do the same when there's that "I'm certain I'm right" sort of resistance. Time to print again and carry.

      BTW, I notice the closing line of the code states it will be repealed 1 Jan 2025. Why?

        Penal Code 27535 was amended in 2023, so that the 1 in 30 day wait would apply to all firearms.
        The old version expired on 01-01-2025 and the new version went into effect on 01-01-2025.

        Old version = 1 in 30 day wait applies only applies to handguns and semi-auto centerfire rifles.
        New version = 1 in 30 day wait applies to all firearms.

          The order (Dkt. 9) granting Defendants’ motion for a stay pending appeal (Dkt. 3) is REVERSED.


          1 in 30 is now enjoined as per the order by Judge Hayes in the Southern District Court.
          No new motions/appeals filed by the state at this time.

            They're (CA) getting their 11% excise tax so more guns sold equals more money for them. What they do in the near future could be appeal, stay, etc. or wait...it's CA so they never just give up or cave. Or make and get a new law passed to workaround like other decisions they can't legally fight successfully.

            I just know having an 03FFL and CA COE definitely makes things better (but not a be all end all to make things same as free states). Yes what you can do has changed over the years (and some places do not know how to handle 03FFL and CA COE), but for the time, money and effort to get them, I think they are definitely worth it in the long run. Yes, taxing or feeing a right is wrong (and many feel unconstitutional) but here in CA the cost $$ especially after first getting them (namely fee for livescan for COE) is not that much in grans scheme of things. 03FFL renewal is easy and relatively quick, and CA COE usually (not always, can take a while) is fast. Bottom line, if you get them, it is important to keep up on rules, laws, etc. and Calguns is a great resource. I have learned alot over 11+ years being a member and am very grateful to the many contributors who share their knowledge.

              So what do I do? I have two CZ pistols I want to sell (SP-01 and "Cajunized" P-01), the SP for 6 the P for 5, take them both for a grand. Evidently, this can't be done?

                It's not likely they can enforce it on all firearms given that it's been enjoined on new firearms but you would have to wait and see what CADOJ does.
