    PPT In California - No Sale, just transfer - Issue at store

    A friend is moving back to Texas. Hes looking to get rid of his 870 Express.

    I went with him to the store today to do a PPT and because hes from Texas he doesnt have a California drivers license. The store clerk said that because he doesnt have a California DL, he cant go through with the transfer.

    This makes no sense to me as I'm well aware that if your from out of state you have 30 days to register your firearms, however this is a long gun. Not sure if
    that makes a difference.

    Any ways.

    I know its legal for him to "loan" me the shotgun for up to, but not exceeding 30 days before I have to declare possession of the firearm. Correct?

    What are my options here? He doesn't want the long gun, I do, hes from out of state, and I would rather I didn't have to deal with him going to a dealer in Texas, FFL/Ship it to the local store (add an additional $80+Shipping and DROS on top of whatever it cost at a Texas shop).

    Is it legal for him to loan me the shotgun, then after 30 days declare possession?

    Hell... What if I drove out to Texas came back to Cali, and declared it? I dont get why the obvious way of handling this face to face with buyer and seller is a bigger deal than it should be.

    You have to transfer it at a California dealer. The fact that your friend doesn't have a California ID or DL means you can't do a PPT at dealer for $35. But you can still do a regular dealer transfer. The dealer can charge you whatever he wants for this kind of transfer. Look around your area to find the cheapest FFL as prices can vary from $45 to $200 (including DROS fee) for this service.

        No, he can't just give it to you. That would be breaking California law (PPT) and breaking Fed law (private transfer between residents from different states).

        Now, anywhere else the FFL transfer wouod be fine, but iirc CA DROS software only accepts CA id and Mil ID, so it's either an under ground regulation or a failing of the system, depending on how cynical you are.

          If a dealer takes it into his inventory, not coming from another FFL (saying that the dealer agrees to buy the shotgun for $1.00 and sell it to you for $1.50) I don't believe the dealer can offer it for sale for 30 days, similar to a pawn or consignment.

              If you want to save the cash for a PPT you will have to wait for your buddy to move here and get a CA DL.

              If not, you buddy can ship the 870 to your dealer, and your dealer sells to you @ whatever his rates are.

              Anything else is illegal.

                Could his TX friend have a CA resident represent him. And the Rep and the buyer go to a FFL to do the PPT ?

                    Does the age of the firearm matter as far as C&R goes? Its an older 870.
