    Regaining the right to keep and bear arms.

    I have a friend whose spouse has a 20 year Felony DUI conviction. Is there legal issue with the friend keeping a firearm in the same residence? How does one go about regaining Gun Rights?

    You should retain counsel to regain firearms rights. It MUST be a lawyer with experience specifically in firearms rights. The steps to get your firearms rights back are critical and doing it wrong the first time can screw you forever.

    I believe that DUI is a wobbler and he must have the charges first reduced to a misdemeanor and THEN have the misdemeanor expunged.

      Until your friend's spouse has done what dantodd has said, then the felon cannot have access to a firearm. Anyone providing access is guilty of a crime, and the felon would be committing another felony by having access.

      A firearm can be stored in a safe where the felon has no access, but things are tricky when ever removing the firearm from the safe. It would need to remain in the non-felon's control the entire time outside the safe when the felon is around.
