I have a friend whose spouse has a 20 year Felony DUI conviction. Is there legal issue with the friend keeping a firearm in the same residence? How does one go about regaining Gun Rights?

You should retain counsel to regain firearms rights. It MUST be a lawyer with experience specifically in firearms rights. The steps to get your firearms rights back are critical and doing it wrong the first time can screw you forever.
I believe that DUI is a wobbler and he must have the charges first reduced to a misdemeanor and THEN have the misdemeanor expunged.
If you are in Northern California contact Don Kilmer and in Southern California contact Jason Davis. You can find contact info for either with a quick google search. -
Until your friend's spouse has done what dantodd has said, then the felon cannot have access to a firearm. Anyone providing access is guilty of a crime, and the felon would be committing another felony by having access.
A firearm can be stored in a safe where the felon has no access, but things are tricky when ever removing the firearm from the safe. It would need to remain in the non-felon's control the entire time outside the safe when the felon is around.Comment
