    Legality of Importing Long guns over state lines

    Hello everyone,
    I'm going to be going to shot show this year and i'm hoping to find a great new shotgun purchase. Something legal in our fine state of course .

    What is the letter of the law in regards to this. Am i forced to pay for the gun there and then have it shipped to my local ffl not unlike say a pistol off of buds.com or the like?

    Is there any way due to the lack of need for registration of long guns to avoid this cost and hassle legally ? I'm not a rule fudger so if it's not kosher it's a no go for me

    If you're a resident of this state and the gun isn't C&R (and you have an 03 FFL) you will need to have it shipped to an 01 FFL. Plus you'll have to pay the FFL's out of state transfer fees in which anything goes. Cheapest I can find and use is $50 and that's their fee not including DROS. I've heard as high as $125. Either it's C&R and you have an 03 FFL, or it's a new gun in which you get a smoking deal to make it worth importing.

      You never mentioned what state the "shot show" is in. But since it's a shot show I assume it's not in California, and I don't think that a stretch.

      To be legal, you definitely do have to go through an FFL because it came from out of state.

      I have a guy who is nice enough to do it all for $40, but I had to call around a lot and I treat this guy like gold because $25 of the $40 goes to the state for their checks and he has to store my stuff for ten days and see me twice.

        Have fun at the show. Try to get some sleep at night.

        As everyone else has said you must go through a CA FFL to take possession. The FFL will collect the state fees, keep your fun for 10 days, charge you whatever fees they choose and are required by BOE to collect CA use tax on the purchase price.

        Essentially the state is taking every effort to ensure that the process is as difficult as possible and tries to discourage firearm ownership.

          Have you ever been to the Shot Show before? If not you need to realize its not a gun show, its an industry trade show. No one is selling to individuals. If you plan to check out some of the LGS you're still out of luck unless you have a C&R for oldies but goodies or a type 1 or 7.

          Have you actually registered for shot and gotten a badge approved? I am the luckiest guy who has been there in the last 5 years, just make sure you know before you go.

            Gun Control Act of 1968.
            Federal laws prohibits the transfer of firearms between residents of different states, unless the transfer is done through a FFL dealer in the recipiant's state of residence.
            Federal laws prohibits the transfer of firearms, except for rifles & shotguns, from a FFL dealer to a resident of another state, unless the transfer complies with the state laws of the FFL dealer and the state laws of the non-resident acqurier.

            CA state laws require firearms to be transfered through a CA FFL dealer.

            Therefore due to Federal & CA state laws, a non-FFL CA resident must recieve a firearm through a CA FFL dealer.

              The two FFL's I've transferred out of state guns through do not collect sales tax. They aren't selling anything. Neither are the privy to the transaction info and for all they know, the item is a gift, especially if the source is a private individual.

              I like to think the savings in sales tax pays for shipping.

                  This is not necessarily true, you can order them especially of you are a distributor. As a matter of fact a LEO buddy of mine picked up a really nice STI and a Nighthawk. Ed Brown wanted me to buy(order) a new 1911 but I told him my gf would kill me lol.

                  You can buy(order) them you just will not be able to take one with you. I hope I am not complicating this matter, oh and you can buy knives and swag on the last day, so its good to bring cash. The prices aren't that great so its moot imo.

                    If it is from a private party then no tax. If its is from a business then they are supposed to. There are topics about this and BOE will get their tax from either you or your ffl. sucks but true...

                      Thanks everyone!!! I figured as much .

                      As shot show goes, i do have my badge already and hotel. I knew that i wouldn't be getting a firearm AT shot show, but after , may be a possible. Find good companies then deal with them after the show. Also going to be going offsite to some ranges and things so who knows .....maybe some interesting things around.

                        Just wanted to make sure you knew what the show was. So many people think its just a big gun show like a crossroads show. Off site American shooters is a good range but I was mostly talking about Media day. Other peoples guns and ammo. Its a unique privilege to go and test out the latest and greatest. Plus the facility they have it as is great.
