    A question of eligibilty.

    In 1994 I plead no contest to and was convicted of violations H&S11378 and VC10851. Last year I filed motions for relief under PC1203.4 and was granted relief in the form of my original plea being withdrawn, a plea of not guilty entered and the charges were then dismissed. No specific prohibition was placed on me by the courts as to the ownership of firearms at the time of relief.

    I studied the law pertaining to my situation (12021...) was unable to come to a clear determination as to my current status. I decided to file a PFEC request and somewhat surprisingly I recieved a response after about two weeks stating that I was eligible to both purchase and possess firearms.

    Seven days ago I purchased a Sig SP2022 in .40 caliber. I presented my PFEC letter at the time of purchase and was told that another backgroung check would be performed.(This I knew)

    My questions are... How likely is it that I will be able to take delivery of the firearm? Am I in violation of any laws? If I am unable to take delivery and attempt to prosecute is commenced, is due dilligence a viable defense. Did I do my due dilligence?

    Thoughts anyone?

    You should be good to go.The PFEC is exactly the same data base they use during dros.

      That's good to know. I wonder if the restoration of rights was automatic with the granting of relief?

        if the PFEC came back okay you should be okay.

        I doubt anything is instant with the courts these days (other than being remanded into custody)
