    hi-cap mag use

    I have a work-issued AR and work-issued 20 & 30 round magazines. I also have personal CA-legal AR rifles with a bullet buttons installed and 10 round magazines. I have a couple of questions.

    1) Since I am allowed to buy/possess/use hi-cap magazines for my work-issued rifle for work and training and competing, may I also use these hi-cap magazines in my personal BB'd rifles when I"m training or competing?

    2) Since the lower reciever is THE GUN. would I run into legal problems if I mate the lower from my issued rifle with the legal length upper from one of my personal BB'd rifles and use the hi-cap mags in that configuration for training and competition?

    No, a 10+ mag in a BB eqpd rifle triggers AW status. (which means the lower would need to be an RAW, and if its an RAW it wouldn't need a BB) But I see you get that by your next question

    Consult your Dept. Policy.

    Pending that, the Lower is the registered weapon. You can use any upper you want.

      1) Read and understand the law! Obviously, any fixed mag centerfire semi auto rifle with a capacity to hold more than 10 rounds is an AW. So, if you put an 11 round mag into a fixed mag AR, you are committing a felony by manufacturing an AW. However, if you have a featureless AR, you do not need a magazine lock (Bullet Button is one brand of many different mag locks but, it is also a great choice!) and can use any mag that you legally possess. If you are LE, you can go buy 20 round, 30 round, 60 round, 100 round, etc. mags and use them as well as your duty mags.

      2) That's up to your employer. I doubt that most LEAs will allow an officer to swap uppers.

      3) It sounds like you need to snap another lego rifle together without evil features and enjoy the use of your +10 round mags and the convience of a standard mag release.

        I forgot about this. Swapping could get you in hot water with your Dept.

            Thanks, all, for helping me understand the AW/RAW and mag laws to keep myself out of felony hot water. I kinda figured as much, but I thought it wouldn't hurt to inquire. My BB'd rifles and lo-cap mags dont even reside in the same area as my work rifle and hi-cap mags.

              NO. INSTANT FELONY.

              You have triggered a secondary 12276.1PC definition by creating a prohibited semiautomatic centerfire rifle configuration - one with a fixed mag holding over 10 rounds.

              However, you could use these magazines in a 'featureless' semiautomatic centerfire rifle - one with no pistol grip, no telestock/thumbhole/folder stock, no flash hider, no forward pistol grip, etc.

              A featureless OLL AR using a MonsterMan grip, a U15 stock or an Exile Mfg stock adapter and having no flash hider or forward pistol grip would be a configuration allowing use of detachable over-10rd magazines.

              2) Since the lower reciever is THE GUN. would I run into legal problems if I mate the lower from my issued rifle with the legal length upper from one of my personal BB'd rifles and use the hi-cap mags in that configuration for training and competition?
              I see no legal issue here, outside perhaps a departmental issue (disciplinary?) about 'modifying' "their" rifle.

                    This is really kinda scary we are having to answer these types of questions for someone who enforces the law
                    maybe I am the only one who sees it like that

                      In the eyes of many leos (insert appropriate reason) black rifles are evil. This is why "educational" campaigns are so necessary to the cause.

                      LEOs are put between two walls, the "normal civilian" wall and the "LEA" wall.
                      Just look at the confusion between AG. Brown note and other COPs that thought they had it all figured out. I can't blame them for checking in here as CGN is somewhat of an authority in the CA firearm law field.

                      I think this just serves as proof that what is ideal in legislature and what is ideal in enforcement obviously don't fit together causing some much FUD.

                        O I know education is the solution, but these are the people that can cause serious legal issues for people who may or may not be following the laws
                        Legal issues=emotional stress,financial stress, and possibly much worse

                        to think there are "loose cannons" out on the street that "think" they know the law is what scares me

                            I have not had any runins and I hope I never do but what scares me is the legal issues even if I am legal

                            I guess anytime anything "special" goes for a trip I have the "Little White Book"

                              Fair enough (re: some folks paranoia about LEO's grasp of Ca's AW/RAW laws), but please don't turn my thread into an LEO bashing thread.

                              Afterall, I highly suspect that a whole lot of participants here and on other gun forums werent as astutely educated about Ca's AW/RAW laws until somebody thankfully (and preferably by a highly qualified person who keeps paranoia out of his/her answers....and actually knows their chit!) educated them...LEO member or not.

                              And if you havent figured it out yet, most LEOs aren't as bad as some of you make them out to be regarding any/most laws and its enforcement. The smarter LEOs should know their limitations...and most know where to find the right answers for their questions....just like "you".

                              I suspect Calgun will continue to answer these types of question even "after all this time" because Ca LEOs have not been mandated by their departments to visit this website, particularly the 2A forum. Calguns and other gun forums will continue to get newbies asking the same questions. Lets be patient about this. Its for our own good. Try not to hate.....its better to educate.
