Would like some clarification on the 16in. barrel requirement

    Would like some clarification on the 16in. barrel requirement

    permanently affix a flash hider of 1.5inches or longer (such as the phantom) to make this legal (ie. welded on). Now, does that mean that if/when my receiver gets listed and I register it as an "assault weapon", does that mean at that time I can then legally use a 14.5in. barrel without a permanently affixed extension? Thanks.

    Yes, you will need to attach the 1.5 inch adapter perm. The overall length MUST be 16 inches. The 14.5 inch barrel is classified as a SBR (Short barreled rifle). Those are NFA items

      Ah... NFA. Ok. I understand now. So what about once if/when the gun is legally registered as an "assault weapon"? Does the NFA SBR 16in. requirement still stand? Thanks.

        Nope, Still gotta be 16 inches. You have to get a permit to do the 14.5 inch barrel. Good luck getting one of those here

          The 16" barrel requirement is a Federal law and has nothing to do with state laws or what "list" it gets added to. The accepted ways to perm attach the FS is blind pinned and welded or silver soldered.

            As BigAl said... and the 16" Fed bbl length requirement is separate from any Fed (expired) assault weapons law - it's been on the books for ages (NFA).

            The 30" requirement is so it doesn't meet the CA definition of assault weapon, one of which is

            A semiautomatic centerfire rifle with overall length of less than 30 inches;

            - do note that this alternate definition is regardless of detachable magazine, pistol grips, etc.

              When did CA add the "30 inch" rule to the list? I thought it was 26" or 26.5", the NFA34 definition.

                If and/or when our off-list lowers become classified as an assault weapon in CA, can we then pay the fed $200 tax stamp and apply for a fed SBR permit?

                  You can, but you'll be shot down. The only people getting SBR permits in CA are movie prop co's that are renting out guns.

                  you have a better chance of winning the new multi-state lottery and moving to a state that allows SBRs =)

                    I was even laughing as I typed the question, but it felt too good, I couldn't stop typing; to think that there might some legal short barrels out here, oh what a joyous notion. After the lower frenzy, I'm starting to think that anything is possible.
