While it is true that the NFA branch also process for dealer-dealer transfers, ->LEA/LEO transfers, do they also take months? It is unfair for some to wait 2-3 months (or more), while other "classes" don't wait as long. How long does a NICS check take? On the short end, minutes, stretching to 3-5 days on the extreme end. We SHOULD be getting forms back within a month, but we don't.

          .
to show you how much work they have, I found this link on another forum, http://www.atf.gov/statistics/ . You can base much of the explosion in forms to the "trust option".

I'm not aware of LEAs getting special treatment. However, some forms are processed faster than others. for instance, Form 3s are approved pretty quick, (since they don't have to do background checks on the recipient SOT) once they make it to the top of the stack. I assume that LEA Form 5 transfers get processed pretty quick as well once they get to the top of the stack, since there no BG check on them either. But, that Form 1 or Form 4 transfer, once it gets to the top of the stack the first time, the fingerprint cards get pulled off and sent off for the BG check (or, if for a trust, I've been told that the trust docs get sent to Legal to make sure the trust is vaild). Once the BG check comes back, then that Form 1/4 has to be processed a second time.

Do you want an AOW or C&R SBS/SBR in CA?

Again, the BG check shouldn't/doesn't take that long, so why the long wait? Its been reported that even approved forms sit for weeks at a time before hitting the mail. Why? Why hasn't there been anything done about this? It takes no longer than a week for the ATF to deposit the check. Once that is done, a BG check should take no longer than 1-2 weeks. Forms should go out by the 4th week of them having received the form. This isn't happening, and unfortunately, the only people really working on this is the NFATCA. Nobody in Congress can be bothered about this (yet). There maybe a big backlog, and if so, temps should be hired to reduce it. Seeing that our current gov't is expanding its own payroll, here is a perfectly justifiable place to do it. But it hasn't....

Also, SOT can file Form 3s (and 2s) via FAX (not sure about Form 5s). While I agree that since there are no background checks, the examiner does have to verify the FFL info is good on both ends, verify LEA info on the form 5. However, I do know of one anecdotal story of a Form 3 taking 2-3 months, but that is an outlier. Here's another one, a Form 4 approved in 1 week, as verified by the CLEO signature date, and date approved. Its another outlier though, because the FFL may not have the license renewed due to local issues, so they had to "rush" it before the FFL expired. He ended getting renewed, but again, things CAN happen faster, but they are not. I'm not arguing a 1 week turn around (would be nice), but the current wait is in the unacceptable area for many people who would get into the game otherwise.
