    OFF LIST PISTOL

    If an OFF LIST pistol is in CA, my understanding anyone can PPT it . Right?

    The term 'non-rostered' is more appropriate, since it doesn't get confused with Roberti-Roos or Kasler listed assault weapons (as opposed to the state's "roster of handguns certified for sale").

    Yes, anyone can obtain a non-rostered handgun via a private party transfer.

      OK. When Ca resident brings it to an FFL to do a PPT to another Ca resident , they do not have to show how they got it? In other words, if the gun is in the STATE its good to go?

        You have posted this question in various forms in a number of different areas...which leads me to speculate you know a firearm was illegally brought into this state and are, for whatever reason, trying to find a concurring opinion which fits what you want it to so the parties involved feel better about doing a transfer on a firearm of questionable origins.

          I'm picking up that vibe as well. Just because back history of a handgun doesnt normally matter to CADOJ when it is PPT DROSed to a new buyer, doesn't mean that the existing owner can go about breaking the law to acquire it thinking that it doesn't matter since it is being PPT'ed to someone else.

            Having gone over your other posts, I believe I've figured out what you are trying to do.

            This from another post:

            A Reno resident brings His Smith and Wesson model 27 and a GEN4 Glock. Are they legally in Ca?
            The answer to this question is yes...the owner is legally able to bring his guns into the State.

            This from another post:

            The answer to this question is NO. ONLY the legal owner may transfer the firearm to another party.

              but if the owner is bringing in an off-roster pistol to sell, then he might be violating this law,

              12125. (a) Commencing January 1, 2001, any person in this state who manufactures or causes to be manufactured, imports into the state for sale, keeps for sale, offers or exposes for sale, gives, or lends any unsafe handgun shall be punished by imprisonment in a county jail not exceeding one year.

                ABSOLUTELY...if someone comes into CA with the intent not only to sell their off-list handgun, but to mask the sale using another party to facilitate the transfer...I would say there is probably a whole list of both Federal and State laws being violated.

                      Nope...but you know as well as I do it's a default situation through the DROS system...not the letter of the law, but no way around it either. Last I heard the legals were "working on it". As you probably already know, CA only recognizes three forms of ID as valid, a CA DL, a CA ID, and a Military ID with orders to a duty station in CA. So in the eyes of DOJ and the DROS system, nobody else in the country exists aside from those with one of those three IDs.

                        Nothing wrong with asking questions...just gets a little suspicious when the same question is phrased several ways on different sub-forums. Most times that happens, the poster is not giving all the pertinent information to get at the real issue.

                          Here is one of the reasons I am asking this . Many people use word REGISTRATION in a wrong way.

                          I know many TIMES people help others to sell their guns to stores and other people ( ppt) .

                          Not once I heard that anything came back......

                          If in Ca handguns are put in the name of the buyer, don't they see that the original buyer is NOT the current seller? Or for that matter where the gun came from?

                          Makes sense?

                            In a lot of cases, the current owner of a gun is not known to the government - registration is not a requirement as an attribute of the gun or ownership of it, it is a result of the process of being transferred through an FFL or the filing of paperwork by the current owner (intra-familial transfer, personal handgun importer).

                              If someone buys a Glock gives it to their uncle a month later,uncle does a PPT to another person. WON"T ANYONE CARE THAT THE UNCLE IS NOT THE LAST KNOWN OWNER?

                              My car is REGISTERED TO ME. If I hand You the keys and You take it . You will not be able to sell it and transfer it at DMV to someone else. RIGHT?
