    open carry question

    We have the right to have loaded arms in case of confrontation, according to the SCOTUS, the prime purpose of the 2nd amendment is self defense.

    Okay, got that, but then they go on about manner of carrying and the general consensus is the we have to have some right to carry, either openly or concealed.

    If someone applies for a ccw permit and is denied their option of carrying a concealed weapon is gone.

    The only option then is open carry, but open carry in california means carryibg a non functional arm plus there is the school zone issue.

    Could someone who is denied a ccw for lack of good cause go to federal court and challenge the state laws that ban open loaded carry and go after the school zones themselves arguing that only the schools themselves should be sensitive.

    In Ohio these actually happened where the Ohio Supreme court upheld a ban on concealed arms saying it was constitutional because the people of Ohio always had the right to open carry.

    The end result of the ruling was mass open carry marches and the result was the state passed a long delayed CCW bill.

    If loaded open carry became a right, the CCW process would probably become a lot smoother.

    I like your thinking, only law makings and average citizen would think that way we might get some progress.

      That has been implied, without having been specifically established, by SCOTUS. I would like to see a "bear" case get there, but until such time as that occurs we're stuck with what we've got. I believe that there are other cases taking priority for a SCOTUS run before any type of carry case makes the trip.

      Honestly though, let's face it, SCOTUS should find what we now know as "constitutional carry" to be the law of the land, but they're going to wimp out and put some feeble watered down limited version in. I have a hard time getting excited about that. The more states pass real constitutional carry in the meantime, the better for any right to bear arms case that gets to SCOTUS, so hope for more of that elsewhere.
