    Shipping and selling.

    When You put a pistol on Gunbroker and sell it out of State. Other than keeping a copy of buyers FFL . What else do You HAVE to do?

    Run the buyer's FFL number through the ATF's eZCheck system and send the firearm ONLY to the address listed.

    If you want to un-register your handgun, file a NLIP form.

      Selling out of state.

      What happens when a Californian sells a handgun that they bought in Ca out of state and ships it to out of state FFL?

      Does it stay in their name in Ca?

        Yes it does. If you want you can send in the "No Longer In Possession" form, but it is not required. Even if you do send it in the handgun will still be associated with you in the CalDOJ computer. But there will be a little notation next to that gun that mentions you transfered it.

        If the police ever find the gun at a crime scene and want to trace it then the trace will end up going through you anyway. That's because they start the trace at the manufacturer/importer and then try to follow the chain of custody from there to the final owner.

                You don't "have" to have a copy of the receiving parties FFL...in fact, more and more of us will only give copies to other FFLs. Checking the ezcheck system is sufficient to confirm they are a valid FFL and the business address to ship the firearm to. They may also require you to ship a legible copy of your ID in the box with the firearm. Simply put, call the receiving FFL and ask what they require from you. And try to steer clear of arguing with them over what's "legally required".

                  When a Ca resident sells a handgun ( that they bought in CA) out of state, can they ship it to the buyers FFL?

                  Or do they HAVE to have a local FFL ship it to the buyers FFL?

                    You can ship it to a FFL in another state. You do not need to go to an FFL here in CA to do the shipment. More info here.

                      There's the law, and then there is FFL policy.

                      When it comes to the law, there is nothing that prevents you as the seller and an individual from personally shipping the gun directly to the FFL.

                      However, MANY receiving FFL's have a policy NOT to accept firearms unless they come from another FFL. This is purely internal policy and not backed up anywhere in law. Some FFL's will claim this is the law, and those FFL's would be flat wrong.

                      Bottom line : Check with the receiving FFL FIRST.

                          Depends on the state. Most states don't have any kind of registration so it's not going to be in anyone's name.

                          What about the old owner , the seller in Ca?
                          California retains those records indefinitely for handguns. As far as California would be concerned that gun is still registered to you. You can file a NLIP form (no longer in possession) with California telling them that you sold it out of state. The gun will still technically be registered to you in CA, but with a note that you no longer possess it or own it.
