    CCW App: Criminal Offense?

Per the CA std app, question #9:

    9. Have you ever been convicted for any criminal offense (civilian or military) in the U.S.
Almost 20 years ago, after getting out of the Army, I was charged and convicted of misdemeanor "Drinking in a public place". Small fine and 1yr of unsupervised probation.

Is this a 'criminal offense' and need to be listed? Will it exclude me from CCW in SLO county? Haven't had so much as a speeding ticket since then.

Just don't see how having a bottle of beer in public could be considered 'criminal'???

I am under the impression that Parkinson is not going to issue CCWs, but we always need a test case!

To answer your question, it is better to list everything rather than leave something out. I know people who were denied jobs with the CHP since they assumed that certain situations which warranted the presence of the police (no arrests, citations, or fines were rendered) were not necessary to indicate on the application or discuss during the interview. CHP was not happy.

Life is like having a map with precise directions and exact stops, you find out that your directions and stops change as you progress further down your original map.

I don't think the question could be clearer, and your answer should be yes.

Otherwise, you get to wonder what they think when they discover that you have not told them something that will probably come up in the BC.

You'll need to disclose that, and the answer is we don't know if that, specifically, will cause the Sheriff to deny you based on his determination of your "moral character".

Now for the $64,000 question: Do I hurry up and apply under current sheriff, or wait for Parkinson to take office?

I'm not sure we have enough data to support any conclusion.

Do you need a test case in SLO county? Small business owner, service-connected 60% disabled veteran, not even a speeding ticket since that drinking in public ticket.

We really can't discuss strategy for future litigation on a public forum. I suggest that everyone sign up as a volunteer at http://calgunsfoundation.org/index.p...r&id=1&reset=1.

Can I use the std DOJ application? Can SLOSD refuse to accept the std application?

Last I checked, they have their own application package, at least I don't remember seeing DOJ anywhere on the paperwork. I plan on applying before the month is out.

Please visit www.gotcarry.org for more information (click on the map, then on the county). SLO must accept the DOJ standard form and cannot require any other application or form. We have a fillable PDF application on each county page.

Also, we should probably merge this into the SLO County thread in the CCW forum.

Yes, it needs to be listed. I wouldn't worry about it; people with similar charges (DUIs, etc.) have been issued CCWs.

They'll find it, so you'll need to be honest about it.

Of course, that depends if your sheriff issues in the first place.

I've read before if you plead no contest to a crime, it's not considered a 'conviction' and wouldn't apply to question #9 mentioned above.

                          Any insight on this?
                          Thanks!

I don't think it matters how you plea: innocent, guilty, or not contest. It is the judge's findings that matter.
