Is it legal if the gun inside your car is in a case with magazine loaded but out of the gun. Also if you put that gun under the seats. Or does it have to be placed in the trunk?

CA law.
Transport and carry all firearms UNLOADED
No ammo in chamber, no ammo in magazine while in the gun.
NEVER conceal a firearm from view, UNLESS its in a LOCKED container. The trunk is a locked container if you can not fold down the back seat while in the car. The glove box is not a locked container even if it locks, same goes for the center console storage box. If its in a LOCKED container it can go anywhere even under the seat.
1) Unloaded in the trunk
2) Unloaded in a LOCKED container.
3) Unloaded in PLAIN VIEW.
If any part of that firearm is concealed from view it can be ruled a concealed weapon. This includes sticking it between the seats. Doesn't matter if the gun is sticking straight up. If the muzzle is concealed...dont do it.
A handgun in a carry case is CONCEALED from view. It is a concealed weapon. Doesn't matter if it has a trigger lock on it and is unloaded...the case MUST be locked.
CA law says all handguns (and other guns that can be concealed) must be UNLOADED & LOCKED in a case when within 1000ft of a school.
Federal Law says all FIREARMS, but that has been questioned as not enforceable.
Ammo can be carried anywhere EXCEPT in the firearm. CA law says you can not carry ammo on school grounds.
Some CCW and all LEO are except.Last edited by Kestryll; 09-21-2010, 10:51 AM.Comment
