    Sue non-CA sellers on Gunbroker

    Anyone ever discuss or are inclined to sue all those bastards who advertise guns etc on Gunbroker and say "No CA Sales". To me this is total discrimination against someone. It's like saying I won't sell to you because you are black, or jewish, etc. And in the lawsuit Gunbroker should take some responsibility for allowing it. If you advertise something for sale to the public, then it's for everyone. You can't pick and choose who you want to buy it. Or should I say you can't deny someone a lawful purchase and discriminate at will. The think the only way to stop this is to sue the seller and Gunbroker out of business. Or at least to get sellers to stop expressing their political views via discrimination.

    No. It is their right to refuse sales to citizens of California. Any person or business may choose where they want to operate provided that the law permits it. For example there is no law forcing McDonalds corporation to sell food in any state or anywhere else for that matter.

      OK, I'll bite.

      You want to force people to sell their private property to someone they'd prefer not to and also deny them the ability to express their own opinions just because you disagree?

      Let them do what they want, let them be foolish and restrict their market. Their stuff, their foolish words - fine with me.

        The reality is that you can sell or not sell, to whomever you wish... as long as your not screwing a protected class.. Like that of race, religion, sexual preference, disabilities, etc. Ca residents are not a protected class and the sole reason these sellers do not sell to us is because of excessive regulation - extra hoops to jump through. As often as it pisses me off, it is their right.

        The best way to deal with it is by educating the sellers and sweet talking them into selling to us if its a legal transaction. I have done this several times. Remember, if we have trouble figuring out the do's and dont's in CA without a lot of back and forth, how do you expect someone from another state to figure out our states BS?

            It's only the sellers (who don't sell to CA residents) who are stepping in their own defecation, and they are doing exactly what the anti's are wanting, and that is to deprive CA gun owners of their RKBA. They are just as much part of the anti crowd as the LCAVs, BCs, etc.

                Yeah really dude...You are in a silly state and suing someone who is actually in a state that allows real guns is a laugh. You want a real gun? Move to a state that lets you own a "real" gun.

                    The great thing about what the gunbroker sellers are doing by not selling to us is, our legal minds being able to show how the bad CA laws ARE affecting inter-state commerce.

                    I also have read that this is also being used in court today to help get our gun rights back

                          Ah yes, the way to get someone to do business with you is to sue them.

                          When I do ebay stuff I typically don't ship internationally. It's just a hassle to me for small dollar stuff. So sue me .

                            If anything the State of CA should be sued for severely interfering and impeding with citizens rights and ability to buy an item which is a right, due to overly complex and anti gun laws, from another State. I would think something in the Interstate commerce clause?

                            I am not sure, the fault starts with this states over bearing, complicated, anti gun and often mis-understood laws due to ambiguous definitions.
