    California Law Questions

    I've been googling looking for the answer and can't find anything helpful, so if someone knows where to look, or the answers to my questions let me know ...

    Ok, so here's the problem. My grandmother passed away 2 years ago, recently my father was going through some of her stuff we didn't go through before and found her pistol (we thought she had sold it). He is ex-military and has plenty of guns and wants to give the pistol to me.

    Is there a way he can legally do this? Since he inherited her whole estate, was the gun included even though we didn't realize she had it? Does he have to register it to himself, then give/sell it to me or can it be registered straight to me?

    Any help would be greatly appreciated

    as long as this is a ca legal gun intrafamily transfers are a-okay from monther/father to son/daughter, but not from sibling to sibling or spouse to spouse.
    there is a paper you can fill out if you want to, registering the gun to yourself but you also need to pay a fee.

      IICR, he can just fill out an interfamily transfer form and you guys can mail it in.
      search "handgun interfamily transer".

      I will now and post what I find.


      here it is. print it out, fill it out, send it in with $19. make sure this is current. call the DoJ if needed.


      just to be clear...YOU fill this out after your dad gives you the gun. You must be legal to own a gun.

            It's not just that. To be "CA legal" the gun must not be considered an AW either. So if it was a semi-auto with a threaded barrel, it would be illegal, period. That's just one example.

              You must also have a Handgun Safety Certificate (HSC). Available from your local gun dealer for $25.

                Or if it was a Taurus Judge, it would be an illegal SBS.

                  In the case of the threaded barrel you could just replace the barrel and the gun would be legal. In the case of the Tarus Judge, you are out of luck - you would need to contact an attorney to deal with removing the gun from the state without committing a felony.

                  But odds are neither of these is the case and your gun is probably CA legal, even if it is not on the roster. Check out the "AW & OLL Guides" drop down at the top of this page, and see the "CA Handgun AW ID Flowchart" to be certain. Assuming there are no AW issues, get your HSC, fill out the paperwork and you are good to go!
