Sykes: 60 Days?

    Sykes: 60 Days?

    Sykes seems to be pretty important. Could someone explain why it will take 60 days to restart? Any way to shorten the period?

    Now that we have the McDonald decision, Nordyke is next. Sykes is on hold pending resolution of Nordyke, which was on hold pending McDonald.

    Sykes won't be scheduled until Nordyke is complete. Since court schedules run 60-90 days in advance for civil issues this could be a while. Add up the times required for the typical motion/response/rebuttal loop & time piles up pretty rapidly.

      Prolly so participants can have time to ammend their filing to taylor their arguements to the language and finding of the McD ruling.

            So, 60 days after last Monday the 28th. Does that include weekends?

              I won't speak on behalf of SAF, Gura, Kilmer, or CGF, but if you look at the RECAP docket you would see the very strong objections we ("we" as in the pro-gun side) had to delaying anything after McDonald. (Judge England split the baby between Sacramento's request and our response). You can bet that the entire 60 days will be the "sharpening of the knives" for us.

                    OK, I think some are getting a bit eager about Sykes.

                    After 60 days do we get a ruling? Or is it that further motions and arguments will occur with a look to a ruling several months after the 60 days are up?

                        The latter. Though I product Judge England will be quicker than Judge Kennedy with Palmer.

                            Not being familiar with how cases like this go (I'm learning fast though) it would appear that we should not expect a ruling for at least another 3-4 months, best case. Is that a fair estimate? Is there a specific time frame the judge has to work in, or can he mull it over indefinitely? I'm not implying he will, just want to learn more about the process.
