    Proposed New San Mateo County Gun Control Laws



    Key points of the first proposed law/ordinance include:

    A second ordinance aimed at owners would require all lost or stolen firearms to be reported to law enforcement within 48 hours of the time they should reasonably have known it was gone.

    It looks like both of these go to the full Board of Supervisors on 12/15 for a vote.

    Any ideas what this will do to our local vendors like City Arms?

    WTF! The last item makes it sound like a minor can't even walk into a Big5 without a parent!

      Dealerships will be prohibited in residential areas and within 1,500 feet of any school, preschool, daycare facility, park, community center, place of worship, liquor store, bar, youth center, video arcade and amusement park.
      Sounds as if this will ban all dealerships almost everywhere, as there can't be many places that are not in residential areas and are also not within 1500 feet of one or other of those places. Hope that they are grandfathering in any existing businesses, but I wouldn't be surprised if not.

        For the most part, this is already going into effect on the state level in 2011 unless HR373 eliminates it.
        Dealerships will be prohibited in residential areas and within 1,500 feet of any school, preschool, daycare facility, park, community center, place of worship, liquor store, bar, youth center, video arcade and amusement park. Exceptions are temporary carnivals or similar events.
        This would kill the industry. Take a look at some of the UOC threads, and the issues that people have with avoiding a 1000ft perimeter. A 1500ft perimeter, including all of the above would effectively eliminate any dealerships from the county.

        But this would be quickly challenged in court and be struck down.

        This looks like a "test case" for the gun grabbers to use an expansion on the GFSZ to bypass 2A and incorporation. State measure will eliminate the legality of online ammo purchasing, so if there is no ammo available locally, there won't be any gun violence

              They do seem to be working quite hard at making us all criminals...

              God forbid they do succeed at pitting us at odds with the law... Somehow I don't think it would produce quite the results they are looking for

                "Those under 21 cannot be unaccompanied by an adult inside a business keeping or displaying firearms capable of being concealed and those under 18 and unaccompanied will be barred from those with all firearms."


                Last I checked anyone who is 18yrs of age or older is legally considered an adult. Talk about restrictions of freedom of movement.


                Any chance there could be a state preemption issue here that needs to be addressed?

                  They don't even realize that it is perfectly legal for an 18 year old to OWN a handgun.

                  I grew up in San Mateo County and I've been ashamed of their attempts at stupid gun laws since I can remember. Does anyone else remember when they passed an AW ban there after the 1987 Stockton shooting? It defined an AW as: "any firearm capable of containing more than five rounds of ammunition"!

                    Why don't they just get it over with and say all guns are illegal in the county! They really don't seem to care about the rights of anyone anyhow.

                      It would be nice if we had a state preemption law like they do in Nevada. Hopefully that will change for us after Incorporation.

                        Aww **** me, the last part of the article reads:

                        If ultimately approved, the dealer ordinance will only govern those in the unincorporated area of San Mateo County. The owner ordinance applies to unincorporated county residents and those whose firearms are lost or stolen within the jurisdiction.
                        Well, I live in unincorporated San Mateo County, so I guess I'm screwed!


                        But really, what is the point, if these dumbass rules only apply to dealers in unincorporated areas (all, what, 6 of them?)

                        ETA - There is a Board of Supervisors meeting scheduled for December 1.

                            I think the idea is to leave business regulation up to the individual cities/towns (incorporated areas) and have the county ordinance just cover the remaining unincorporated areas. I don't see how any of this could be legally challenged, as counties and cities can make pretty much any zoning/licensing/conduct restrictions that they like, and there is no state or federal preemption for most of these types of laws/regulations.

                              What a bunch of BS.....it's like they want you to be buying hot guns out of some dudes trunk in East Oakland. Is there a shred of common sense left? All this will do is make it near impossible for law abiding citizens to buy guns and ammo and won't affect crooks one bit.
