Kathy Lynch (and Gerry Upholt) Return

Many of you may remember that Kathy Lynch sent a litigation threat to CGF, CGN, and BWiese.

On September 11, Ms. Lynch's attorney sent a new litigation demand. Interestingly, her counsel now appears to also represent the former CRPA lobbyist, Gerry Upholt.

The good news is that her counsel has realized that Calguns.net and The Calguns Foundation are not even plausible targets of her litigation demands. CGF replied with this letter.

However, though the demands made have decreased, Ms. Lynch and Mr. Upholt are continuing to threaten Mr. Wiese with litigation. As the point of the CGF is to defend the rights of California gun owners including their right to free speech, the CGF board (with Mr. Wiese abstaining) approved defending Mr. Wiese should that be necessary. Mr. Kilmer has responded with this letter to Ms. Lynch and Mr. Upholt on behalf of Mr. Wiese.

CGF will not allow protected free speech that is within the forum rules of Calguns.net to be chilled.

Wow, post has only been up for 15 min - I thank all you Calgunners for the kind PMs & support emails!

I hope you take that spirit and spend the time calling, emailing, faxing and writing the Governor to VETO AB962 ammo restrictions and the SB585 Cow Palace gunshow bill.

But It's gonna be OK. Don Kilmer's on the job.

The opposition is San Diego condo lawyers - puzzling at first glance, since the supposedly traumatized parties are in Sacramento, and are not condos.

They're actually right on one thing - I was brain dead on the old ammo bill number, AB2731 - it should be AB2714.
      I apologize for muddling trivia.

The good news is this won't interfere with other activities (Nordyke progress, "Roster case", Sykes "CCW case", etc. - plus some of the 'daily grind' CGF work.) I'd throw myself under a bus before I'd let that happen.

But can we still say "solid neoplasm" in the 1st Amendment sense? That was one hilarious bed time story.
False is the idea of utility that sacrifices a thousand real advantages for one imaginary or trifling inconvenience; that would take fire from men because it burns, and water because one may drown in it; that has no remedy for evils except destruction. The laws that forbid the carrying of arms are laws of such a nature. They disarm only those who are neither inclined nor determined to commit crimes.

Sounds like a crazy lady to me, I can understand why she would be upset about some of the posts but geeze, if we could all sue each other for stuff like that nobody would have any money left but lawyers!

Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes...Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.

That non esquire Mr. Kilmer deserves some sort of hilariously assertive attorney writing award.

I haven't, and have sent emails and a letter. That stupid phone line is always busy, though.
Is Kathy and Gerry going to send in letters or make phone calls to the governor to oppose AB962 and SB585? If not, I want to sue them for dereliction of duty and causing my Constitutional rights to be diminished!
