    Forceing Private Party Transfer

    DOJ Requires shops to do Private Party transfers of firearms.

    My girlfriend wants to transfer her OLL into my name. I do not feel like making 2 trips to Taft to do this (Sorry Wes).

    Bakersfield FFLs have decided to avoid the whole OLL thing.

    I doubt the DOJ is going to help me force the Bakersfield gun shop to transfer an OLL.

    Am I pretty much stuck driving to Taft?

    I've had no problem getting non OLL friendly FFLs to PPT OLLs. They correctly see it as having a different exposure profile.

      You can't force a FFL to transfer a firearm they are not legally comfortable transferring.

      Just move along, find someone else.

          You can't really "force" any FFL to do a PPT because they could simply tell you to get out or else have you arrested for trespassing. Any business could tell you that, so while you could cry to DOJ, I wouldn't expect them to do anything about it.

            That's not really true, an FFL is not like any other business in that they are subject to provisions in the penal code. The fact is, if you wanted to make a big deal about it, a dealer refusing to do a PPT or charging more than 35.00 for it is in violation of PC 12082 and guilty of a misdemeanor. You could actually arrest that person (PC 837), or just call the police.

              Hmmmmm.... There is a certain gun dealer here in town that does not like to do PPTs and LOVES to cancel DROS apps if twerked. I wonder....

                  While this is true, if the FFL believes the transaction to not be legal, or is worried that the legality is in serious question, the charges would most likely never stick...
