    What are the criteria for the denial of RKBA due to mental illness, and is there a way to appeal?

    As far as what's on a record that is checked and you get denied when your background is checked? It's not a 5150, but rather the one after that, 5170 I think it is?(the 5150 is just a 3 day hold, the one beyond that is if it's determined that you need to stay locked up for a while).

    edit: Other than that it's a matter of the dealer refusing the sale based on the questions "are you a danger to yourself or others, blahblahblah". If you go to a dealer and ask for the best pistol to blow your brains out with, they're supposed to deny you the sale.

      I believe that you're talking about a 5250, rather than a 5170.

        Edit to add: I just realized I responded as if you were denied. Sorry, I'll leave the info I found anyways.

        Call the DOJ. There is a number to call and set up a hearing. Will involve having a doctor testify on behalf of the individual. Thats what I was told when I called for a family member. Its been two years for them and I was told five years or a hearing.
