Polymer80 build kits legality in CA- LAPD sting

I remember reading about the ATF going after vendors that were selling complete P80 kits (80% lowers + LPK + complete slide/barrel assemblies). But I do not recall seeing this being an issue currently in CA with respect CA law.

The reason I ask is because I have a friend who was recently taken into custody for trying to sell his P80 kits here on CG. He had no idea that the buyer was a UC and during the FTF transaction, he was swarmed by LAPD with guns drawn. This happened in West LA. He was cuffed and taken into custody, interrogated, car was searched, and then released because he is a squeaky clean average joe that didn't break any laws. They did not return the 2x P80 kits though and warned him that he was lucky they didn't book him. It seems clear to me that they were just fishing because he didn't break any laws, otherwise they would have booked him right away. Needless to say, he was quite shaken.

Anyway, I just wanted to share this story with you guys.

Maybe your buddy got ripped off..

I don't think any new laws on this go into effect till July 2022. Unless it was a finished frame California still considers it not a firearm.

AB1057 pass which makes unfinished frames defined as firearms for domestic violence goes into effect July 2022.

The ATF rule making process isn't complete on changing the definition of finished frames, would take still months.

Out of 179 homicides, there were 24 killings and eight attempted homicides using "ghost guns." (17%) There have been "dozens of assaults and armed robberies since January allegedly using "ghost guns" out of 1,271 for the year to date. So we have maybe 60 to 80 crimes committed with known ghost guns, yet the police have confiscated 863 ghost guns that were presumably NOT used to commit a crime but were taken during a raid or arrest, roughly 1/3 of all guns confiscated. How many of these were under red flag orders? How many were never used to commit a crime? Wo what we have is a legislative act establishing that guns in and of themselves are a crime, irrespective of the use to which they have been placed.

Building off an 80% lower has never been a must have for me and I knew that this loophole would eventually be closed.

I understand your point but this has nothing to do with a completed 80% build. It was simply the parts to do so.

                  AFAIK...
The City of Los Angeles recently (08-2021) passed an ordinance banning the possession, transport, and transfer of "80% parts kits" within the City of Los Angeles.

If that is the case then he is extremely lucky that they did not book him on anything and simply let him go.

Violating that LA city ordinance is suppose to be a misdemeanor/infraction wobbler, $500-1000 fine and/or up to 1 year in jail.

But, due to the current COVID mandated catch/release directive from the CA Governor, they are just doing warnings with confiscations for non-prohibited persons that are caught and confiscation with felony possession of firearm/ammunition charges for prohibited persons that are caught.

San Diego County as well. I haven't caught the details when it takes effect or if they're still ironing out the specifics. The P80 pistol kits are really the problem for law enforcement the most. There's no legal way in CA to build one out into a functioning Glock clone. So yes while the parts themselves are not yet a gun, you can't legally build it. And that's a problem for writing laws against it, and what they've done is blanket ban all 80's, even the AR ones where there is a legal way to build one into a rifle if you chose. They've gone to "pre-crime" enforcement, and that's bad for liberty.
