    San Diego Municipal Code clarification

    So I want to do an OC beach cleanup and the next one is on the 13th of June on Fiesta Island in Mission Beach. Looking through the Municipal Codes, it seems that they don't allow firearms for UNAUTHORIZED persons "under law or city permit." Being that I am not a prohibited person (therefore authorized to own and carry a firearm) do you guys think that this code applies to me?

    Here is a copy of the relevant Muni codes.





    This should prove interesting.

    San Diego has changed from a city manager form of local government to a strong mayor form, so this ordinance needs to by tidied. No guns in public parks in San Diego region is common. I would like to see them regarded as not so "sensitive".

    Of course the gang bangers still carry in the parks and shoot people there. Local law enforcement does not seem to be able or willing to stop that.

      Right right, but these ordinances are inherently illegal. It isn't as vague as O'sides but still, it is equally as lame.

      As long as it isn't a COUNTY park then I am cool, though I am up for advice and whatnot. If I do this activity with other people I don't want them hung up on this crap or anything.

        Are you "specifically authorized by law" to "possess, transport, carry" a firearm on or into any City Park or designated open space area?

        Unless you have written permission from someone authorized to provide that permission I would say you can't UOC in any City Park or designated open space area.

          How about calling your buddy the Captain and asking her what their belief is? I think she is in charge of Fiesta Island policing as well as the beach area.

            This is the way I read it. That 'specifically' is whats going to get you in trouble.

              Emailing the Captain this question now.

              That word "specifically" does provide some rumination fodder but no specific criterion are given nor code referenced. Specifically speaking, I am not a prohibited person, correct?

              Let's see what the good Captain has to say.

                Following some of the wording of the recent Nordyke ruling...

                I believe these municipal codes are pre-empted since they bar possession (keeping/bearing).

                A beach or open space would not be a sensitive place or area of municipal property since there are no "secure" entry ways. I am curious how they could argue that.

                But, IANAL so you should seek the advice of one before carrying on municipal property...

                    You do understand the futility of trying to clean Fiesta Island?

                    A successful cleansing would result in more room for jet-skis and a 100 yard road to the launch area and nothing else.

                    Then where would we do the OTL thingy?
