Pena case is currently under review at SCOTUS. its stuck in limbo right now. it is thought that SCOTUS is holding Pena until the NYSRPA case is ruled on in June? I assume that once they rule on the NY case, then there will be movement on Pena, perhaps kicking it back to the District court with hopefully language like "remanded back to district court, see strict scrutiny in NYSRPA".
