    "School zones"

    Just a germ of an idea, so feel free to shoot it down.

    CA has felt that it can ignore federal drug laws, by passing contrary initiatives (IIRC)...and it has defended that in Court IIRC (may also be other examples).

    So, how about a city or County passing laws negating (or limiting) school zones (PC 626.9?) and (possibly) UOC bans?

    How does the state prosecute an entity further down the food chain, while simultaneously contesting the same principle with the feds?

        This analysis relies on the assumption that the Federal Government is in control of, or over the State in its authority. This is not how the system is. The Federal Government and the State Governments are seperate entities. While the Federal Government has authority in certain areas as set forth in the Constitution, the States hold all the powers not specifically granted to the Federal Government by the Constitution.

        At least that is what the system is designed to be.

        The County and City Governments on the other hand are indeed subject to the authority of the State in ways that the State is not to the Feds.

        Wyoming (IIRC) is trying to pass a law or resolution that says that if a gun is made in Wyoming, and stays in Wyoming, then the Commerce Clause doesn't apply and the Feds have no jurisdiction over the gun or it's carry. In other words, they say if we made the gun and it didn't come from any other State to give the Feds authority, then they can carry it in a school zone and the Feds can go pound sand.

        The cities and counties on the other hand have no such recourse against the State.
