    AB 1869 Melendez/Gray, 2016 - Theft: Firearms, Nullify Aspects of Proposition 47



    NRA supports this bill

    The California Constitution authorizes the Legislature to amend an initiative statute by another statute that becomes effective only when approved by the electors.

    This bill would amend that initiative statute by making the theft of a firearm grand theft in all cases and punishable by imprisonment in the state prison for 16 months, or 2 or 3 years.

    (2) Under existing law, a person who buys or receives property that has been stolen, knowing the property to be stolen, or who conceals, sells, withholds, or aids in concealing, selling, or withholding property from the owner, knowing the property to be stolen, is guilty of a misdemeanor or a felony, except that if the value of the property does not exceed $950. Proposition 47 makes the offense punishable as a misdemeanor if the defendant has not previously been convicted of one or more specified serious or violent felonies or of an offense requiring registration as a sex offender.

    This bill would amend that initiative statute by making the buying or receiving of a stolen firearm, with knowledge that the property was stolen, or the concealing, selling, withholding, or aiding in concealing, selling, or withholding of a firearm, with knowledge that the property was stolen, a misdemeanor or a felony.

    (3) This bill would call a special election to be consolidated with the November 8, 2016, statewide general election. This bill would require the Secretary of State to submit the provisions of the bill that amend the initiative statute to the electors for their approval at the November 8, 2016, consolidated election.

    The (California) Department of finance department of
    finance is opposed to this bill because
    it could increase the state prison
    population which impacts our ability to
    comply with the federal court's order to
    reduce prison overcrowding to 137.5%
    of design capacity
    additionally we believe it can result in
    general fund costs that are not included
    in the administration's current fiscal
    plan.

    we would also note that the secretary of
    state may incur additional cost to put a
    new measure on the ballot.
    Any comments or questions from committee
    members?

    I would just like to note that on this
    particular bill is similar to some of
    the other firearms bills. It has less
    cost than a number of those.

    this one is going to suspense; rightfully so

    But i think that we need to note the
    difference here with the group that came
    through on special meeting i think it
    was last week and many of those exceeded
    the cost of this one.

    So Department of finances to note that.

      Can't believe the heathens in Sac won't allow this through. If there's a more stark example of their hypocrisy, officially, right now, IDK what it is. I mean prisoner 19629-111 (aka leland 'gun running secretary of state hopeful' yee) is a better example but that's old news right?

      They talk about "gun safety" but won't punish firearms theft. Oookaaay. Morons.

        Everyone knows that stolen firearms have a very high probability of being used in a crime and the state does not want to deal with it because the prisons are full, yet they want to arrest people for not reporting a stolen firearm in a timely manner. To me it seems the laws that are being proposed are backward and The list of unfair laws are almost endless.

          So this means if someone doesn't register their AR later on down the road, they can just claim they stole it right
          But I don't come 'round here to meet nice people anyway
