this is the response i got, which was email

Take it however you like. If you don't like the
    rules, start your own
    forum. Please, go right ahead.

If you want to post legal for sale ads, I'll still
    put them up for
you, but this flaming arguing business has no
    place here. If you or
others want to leave because of this, I will
    hold the door politely
open for you. Feel free to unsubscribe
    whenever you like.

my response to the above would have been that
'dave' started this 'flaming', not i, and that
i was not doing any flaming- i even reminded
him and jon that this group was supposed to
be for ads, etc. however, i was not going to
just sit there and not respond.

also, i would have gone into details about
the private party transfer that i mentioned,
listing exactly how it was done, what my
dealer and the seller's dealer said to do to
for it to be legal, etc.

    the yahoo group says:

    'Description

This group is intended for the posting of for
sale ads for southern and northern california
sportsmen whi wish to sell their guns to
    local buyers.

    ALL LAWS AND LEGAL REQUIREMENTS
MUST BE MET. Violators will be banned.'

as far as i know, it is not illegal to post the ads
i posted, nor to explain things the way i did.
i was not planning to do anything i knew to be
illegal either- for example, i knew that i might
not be able to legally buy the saiga-12
shotgun i wanted. i assumed that if if i found
one for sale, i would call my local dealer and
the doj and ask. if they said no, that would be
the end of that possible transfer. i would have
then written to the doj, explained things, and
asked if there was any way for me to obtain
    one.

    what do you think?

    m ades

    please note that i have
    deleted most of the quoted
    material.

i tried to post this as a
    reply to the first part,
    but kept being told the
    thread was invaild... not
    sure what that means, so
i am posting this as a new
    topic.

posting problems on yahoo calgunsale, part 1

my original part 1 seems to
not be here, so i am trying
again, as a reply to this
    post
    -----------------------
    to whomever on calguns.net

i am posting this here because the guy who
started? the yahoo calgunsale group is
refusing to let my posts appear on that group.
i am posting this here only to let people know
what is going on, since they cannot read my
last post on the yahoo group.

    versions, san francisco. mdades2

i'd like to buy a saiga-12, 12 gauge shotgun. in
    order of model preference 12s exp-01, 12-k,
12-c, 12-s, 12 with quick detachable butt and
    pistol grip, 12 basic.

ideally, i'd like it new, with the threaded barrel
for the changeable chokes. realistically, i'll
probably take what i can find.

this should have been in california and registered
before being banned since even the basic gun
is considered an ak-style assault weapon by
the doj despite not having a pistol grip or
folding stock. this means i am not very likely
to find either of the 12s versions unless the
    seller was in law enforcement.

the private party transfer can be done either
face-to-face in san francisco, or via fedex
overnight (preferable) using my local dealer
    and your local dealer.

please contact me via email if you have one to
    sell.

    i'd like to buy a kel-tec
    p-32, a p-3at and a pf-9.

if anyone has any of these
    guns and wants to sell,
please let me know via email.

we can do this face-to-face or
    via fedex overnight from your
    dealer to mine (preferable).

    i'd like a new, second-
    generation p32 model in
    hard chrome, a new,
    second-generation p-3at in
hard chrome, and a new pf-9
    in hard chrome.

    realistically, i'll take
    what i can get- slightly
used, blued, etc. i do not
    want a first-generation p32.
    i'm not likely to get a pf-9
    unless you're a leo.

    thanks,

    m ades

If it is a CA-registered assault weapon then it
    can't be sold to another
    private party in CA...

You CANNOT own this weapon in CA if you
did not own it prior to 2000.
ANY detachable mag semiauto shotgun is
    banned and cannot be
    re-transferred under any circumstances,
    registered or not, unless you
have an FFL andd an AW permit.
Sorry to be a bubble burster. Go buy yourself
    a benelli M1 Super 90
    instead and be happy.

You CANNOT do this either. Off- SB15 list
    weapons must be transferred
face to face **ONLY***. Shipping them is
    illegal, and is treated the
same way as imprting banned pistols from out
    of state. ALL Kel Tec
pistols must be transferred in person, period.

Please do not make any other illegal requests
to the list or you will be moderated.

Go to www.calguns.net if you have ANY legal
    questions whatsover. They
will provide more info than you bargained for.

well, not the saiga specifically listed...

if you could find a SAIGA kit, and put it on an
    off-list AK reciever....

but that is a discussion for Calguns.

Aaah.. but any detachable mag 12 gauge
    shotgun (poster asked for a
saiga 12-gauge) is banned under SB23 as a
    de-facto AW. You'd have to
pin the mag in place even with a straight stock. Kinda makes it
pointless, IMO, and I'm not even sure if you
can top load a single stack 12 gauge mag..

Yep- A tube-fed semiauto shotgun holds a lot
more rounds in a much smaller space. But
SB23 is written to ban 'cool' looking guns,
and a detach-mag shotgun is one of them.

Download your free copy of SB23 here:
    http://ag.ca.gov/firearms/forms/pdf/awguide.pdf

    Shotguns
    (7) A semiautomatic shotgun that has the ability to accept a detachable magazine.
    (8) Any shotgun with a revolving cylinder.

i was not asking for opinions, i was just putting
    up ads.
this is a for sale forum, not a discussion forum.

    >Sorry to be a bubble burster. Go buy yourself
    a benelli M1 Super 90

i can only use something that can be loaded
and fired with one hand as i can only use one
hand at a time, and which weighs as little as
possible as well as having as much weight as
possible at the back of the gun. this means
    either a semi-auto mag-fed gun, or a
single-shot, and the single-shot is out for
    self-defense purposes.

as to the above, that just shows that you do not
know what you are talking about. i checked
with the doj if i could do a off-list transfer this
way and they said i could, so i then proceeded
to buy a kel-tec handgun in just that manner.
    i did this last month.

no ffl can transfer what to me? as i said, they
just did with the kel-tec, and with the doj's okay
    and usual background check.

Congrats. Your posts will be moderated until
you educate yourself with CA gun laws. I will
    not have misinformation spread feely
on this group, nor blatantly illegal activities
asked for.. As was suggested before, mosey
over to calguns.net and get yourself an
    education.

    ------------------------------------------------------
from m ades- this was my attempted response.

    7/16/06 842am

as to calguns.net, i've been there many times.
much of what i've read there in the legal area
seems to be opinion or anecdotal. i've seen
nothing that i can trust 100%, by someone
who verifiably works for the doj legal dept.,
    for example.

as to you, whoever you are, i guess you cannot
read. did i not say, twice, that the doj
specifically okayed this sale in this manner?
that they said it was legal? i personally called
them beforehand. if the doj says this is legal,
then it is legal, and you should not be trying to
tell me to learn something that you do not
know correctly yourself. as i am stating
something that actually happened, and was
informed by THE authority in these matters,
i am not spreading misinformation, nor am i
blatantly asking for illegal activities. i will
continue to post ads that contain nothing that
is illegal to my knowledge. if you do not like
    it, that is your problem.

if you happen to be the person who started
this forum, you may be able to delete posts you
do not like. if that happens, i, as well as i
hope others, will take that as a personal attack,
not befitting the purpose of this forum.

          This doesn't belong here.

And you do realize you're publicly stating you want to commit a felony:

This makes about as much sense as trying to spill an argument from ar15.com over to here. Thread locked.

Oh yeah, I should probably mention - Calguns has *NOTHING* to do with that Yahoo group over there. It was started by a Calguns member to fill the void left by Calguns not having a for-sale forum.

If you have issues with that group, take it to the yahoo group, leave it off of Calguns - we're not related in any real sense.
