      Richards was reversed and remanded. But GMC was taken off the table by Gura. We will need to wait for a sheriff to play games with GMC before action can be taken.

        It's possible that it was a tactical move in order to get any challenges to Richards and Peruta to exactly line up with Drake. If Peruta gets through this without an en banc hearing that would take a year or two, suddenly you have Drake in the SCOTUS conference with two cases coming out of the 9th that are 100% matches in challenge. It would give Drake the best chance for it to be heard in front of the SCOTUS.

          I am not exactly sure how removing GMC from Richards helps Drake since Peruta makes the split. Your guess is as good as mine. However, the GMC was dropped and now a new set of cases will need to be brought against sheriff's who play GMC games

            If carry is recognized as a fundamental right, which is what happened in Peruta, then GMC is irrelevant.

              And yet, no county that has change policy on GC has change there background requirements or interviews to determine GMC

                I concur. In addition, we have left the universe of the impossible and have now entered the twilight zone in which we may actually be able to obtain a CCW even in Los Angeles County. Amazing grace.

                  The Peruta decision did not invalidate GMC as an element of issuance. While satisfying it is definitively subjective and arbitrary, it has not been eliminated and thus will remain relevant to whether you are, or are not, issued a CCW.

                    What fundamental right can have a moral character requirement to exercise? That's the point, by deeming carry a fundamental right you can no longer force someone to prove their good moral character to exercise the right.
