    I think its possible, but unlikely. If they moot Pena, my tinfoil hat will be permanent fixture.
    ...Well, Mr. Dangerfield can feel better about himself now, because with Proposition 63, the Second Amendment gets even less respect than he does....

        Anyone want to take a guess on a time frame of when we might hear from SCOTUS whether they’ll grant cert on Pena, or not, after today?

          I was pretty bummed about the allowance of mooting but perhaps it was a last bone thrown to CA to moot their laws now or get slapped. That's my hope to hang to right now. Although with CA legislature on hiatus and letting Newsom run the show unchecked its doubtful they would get the hint or act on it.

            If I understand the process correctly, they will release their orders this Monday morning.

            Those orders could include "cert denied" for Pena. If so, that's the end of the case. There's nothing left after that.

            Those orders could also include a "relist". That means they are still considering it, and will consider it at their next conference. If they relist it, it will probably be relisted a few times, and that's a positive sign that they will do something with it other than cert denied.

            They could also accept it, or GVR it, or probably other things. But the most likely two options are cert denied (the end) or relist (probably something will happen).

                Given this article is from 2015, so much has changed in terms of the statistics, but this is a good jumping off point to understand the next steps and the chances.

                I believe this and most of the other 2A cases have already been listed once.

                  Yeah but this is a different situation, as all the 2A cases have previously been held in limbo and also relisted. They're very aware of the cases and at least 4 of them want to address the 2A sooner than later. The 2A cases have been lingering for a year almost. I think a relist is positive but they could also relist a bunch of times and then give up on them too.

                      It's a little interesting that none of the 2nd amendment cases are among the long list of the cert denied or re-hearing denied cases. Could that signal that they are looking further and possibly consolidating them? Not sure, just wondering what it means.

                          10 cases get dumped on them and you expect immediate reaction? What I think it means is 9 justices said "Wow. It is going to take some time to digest all of this. Good thing I have clerks, and I can ruin the next 4 weekends for them, instead of my own weekends."


                          I am guessing there are several SC clerks are busy reading/digesting/summarizing so that the justices can be efficient in how they process all this information.

                            Most if not all have been listed before, last year. You might think much of the work you described happened the last time. It may follow the work ahead is how to consolidate and/or move forward.
