    Is there a CURRENT lawsuit about [some CA gun law]?

    Well, there just might be.

    This thread excludes all those that were denied cert or lost at trial.

    Alphabetical by Plaintiff/1st Plaintiff, these are links to Calguns threads about the cases; often, but not yet consistently, the first post in such a thread has a list of status changes or events, most recent at the top of the list.

    This may be useful because it can be years between updates on the cases, and the threads slowly sink to the lower pages.

    (Note: "Becerra" is "Attorney General of California Xavier Becerra"; for an open case, if the AG should change, the AG name on the suit will also change to match. Same thing happens when another named defendant no longer holds the office, the new officer is substituted into the suit.)

    This is NOT a discussion thread.

    If you have a favorite case I have left off, please copy the thread title and URL, and post them below. (It would be really nice if you could update that thread with some status info so we can see where it is today.)

    CA cases only, please; somewhere I've seen an off-Calguns list of cases that seemed pretty complete nationally, and better that person maintains that one ...

    And I'll try to add new cases to the first post, alphabetically as already done, as they may be filed in the future.

      While not applicable, strictly, to only California and not something filed by "the good guys," there's - State of California, et al. vs. BATFE, et al. - "Ghost Guns" - Filed 9/29/20

      The case was assigned to Obama appointed Judge Chen on 15 October, but the next scheduled event isn't until 1/14/21.

          09/19/2022: Check cashed in
          08/28/2023: Phone Interview

          12/05/2023: Training Submitted & confirmed receipt
          03/13/2024: Call for Pickup
          04/10/2024: Picked up the CCW license!

                Boland v bonta and Renan v becerra are both lawsuits against the roster.

                Boland v bonta asks that the law be invalidated and it’s enforcement enjoined.

                Renan v becerra only asks for enforcement to be enjoined.

                Roland is the better lawsuit, but why are there two separate lawsuits by different law firms. No one is coordinating?

                    +1 All access to CG should be over https. If you use http, your ISP and everyone else (e.g. hotel wifi) is logging and cataloging what you do.

                      I don’t see any case challenging CA’s CCW Good Moral Character requirement. That’s the law right now, no need to wait for SB918 to be re-introduced, pass the legislature and pass the governor.

                      Maybe waiting for it to become law to hit its multiple unconstitutional requirements in a single case?

                        What about CRPA v City of Glendale?
                        Case Name: California Rifle & Pistol Association and Gun Owners of California, Inc., Second Amendment Foundation v. City of Glendale, Glendale Chief of Police Carl Povilaitis, in his official capacity, Glendale City Clerk Suzie Abajian in her official capacity Case No.: 2:22-cv-07346 United States District Court, Central District of California Filing Date Filing Party


                        This is a suit against what the City of Glendale deems "Sensitive Places" such as all City property including parks, playgrounds, open space, plazas, community centers, facilities (including the Glendale Civic Auditorium, the city’s civic center complex, and city libraries), parking lots, and parking structures.

                        This seems like an important lawsuit to pre-empt similar restrictions in a soon to be introduced SB918 successor.

                          California's residency requirement to carry in CA

                          As best as I can tell California law will not allow a California sheriff or police chief to issue concealed carry permits to non residents and California law does not recognize permits from any other state. While Oregon does not recognize permits from any other state they will, on a may issue basis, issue to residents of Washington, Idaho, Nevada and California. It is just a matter of finding a friendly Oregon sheriff. While there are other states that will not issue to nonresidents, like Montana and Wyoming, they recognize permits from other states. Thus, California, unlike most other states, clearly infringes on the right to travel of non residents who want to carry in California and have permits from their state of residence and possibly other states and who would not otherwise be disqualified. Two questions. Is anybody aware of a group planning a suit to challenge California's no carry restriction on nonresidents? Next, could the suit be filed in any federal district court in California or would it have to be filed in the Eastern District of California (Sacramento)?

                            There is the 90-day, good only-where-issued version at PC 26220(b).

                            I have seen unverified suggestions that that provision has been used to license VIP protection people.

                            That's not a general case, usable in this context to assert some kind of liberality.
