You are Correct, which is why I quoted the shotgun capacity question.

A buddy in our hunting party swears up and down its only 3 rounds for any weapon used. I told him he is incorrect and he says he asked a game warden once and was told 3 rounds for shotgun, rifle...no matter.
I tried looking up the info in the regulations with no luck and emailed fish and game with no response back.

Took the hunter safety course last November. The instructor definitely communicated that there's no limit on mag capacity for rifles for hunting, besides the 10 cap california law.

If there's no restriction, then you're probably not going to find it in the regs. I haven't personally looked though.

                  ah, check this out: http://www.dfg.ca.gov/publications/t...ggm2004_11.pdf

                  it's the last question.

                  Question:
I went to my local sporting
goods store to buy a back-up rifle
magazine. The rifle came with a
                  three round capacity magazine
(not counting the one round in the
chamber). I wanted to buy a fiveround magazine. The salespeople
told me they believe that there is a
limit of three rounds per magazine
in California. I am aware of the
                  three shot-shell limit, but I can’t
                  find any reference to maximum
rifle capacities. Is there such a
                  thing?

                  Answer:
                  You are correct, the “three-shot”
limit (total capacity of gun) applies
to the use of shotguns while
                  hunting big game mammals, small
                  game mammals, resident and
migratory upland birds or waterfowl. A shotgun may not hold more
than six shells when taking nongame species or furbearers. There is
                  no magazine size restriction for
rifles under the provisions of either
the California Fish & Game Code or
                  the California Code of Regulations/
Title 14. Laws pertaining to rifle
                  magazine capacities generally are
                  addressed in the California Penal
Code and hunters should be aware
of PC sections 12276 and 12276.1,
                  which define assault weapons. Any
                  semiautomatic, centerfire rifle that
has a fixed magazine with the
ability to accept more than ten
                  rounds is considered an assault
weapon. For a complete overview of
                  applicable firearms laws, hunters
are encouraged to go to the California Department of Justice’s website
                  at: http://caag.state.ca.us/firearms

Your buddy is wrong. Let him do what he wants. It's like my friend that shoots his rifle off of his right shoulder with his left eye (Yea, imagine that) because he's left eye dominant and doesn't want to switch sides. I quit trying to help him years ago.

Always hear that, " I heard it from a gare warden" BS. You rarely ever see anyone show you the actual regs in person.

In my experience, most people who claim to have been told this type of bad info from wardens, are lying. They just add that to the end of their claims to make themselves more believable, or SOMEONE else told them they were told by a warden, and they just take it as their own. It's always best to check the regs yourself.

DFG link is accurate. No limit on centerfire as long as the magazine is legally owned. I am a Hunter Ed instructor. This is covered in the class, it is in the manual for the class, and in the big game booklet the state prints.

Carrie Wilson, the DFG biologist who writes a weekly column for the Western Outdoor News, has answered this same question at least once a year for several years that I am aware of.

It's one of those things that won't die, like loaded mag = loaded gun.
