Lots of threads on this. If this person is one of the newly roster exempt LE types listed in PC32000(b)(6), and used the new exemption in PC32000 to acquire the gun, then a FFL may not process a transfer to anyone but LEO, per PC32000(c)(1).

However, traditional LEOs who have always been exempt, can still sell to whoever they want. The new law only applies to a narrow subset of LE types. But a lot of LEO are being sold on FUD, and think they are subject to the new law when they are not. However, some agencies have policies that restrict their employees sales no matter what the law allows.

Appreciate the info. I've called FFLs getting mixed responses. Few stated yes it's ok to sell to civilians ect. But who knows nowadays.

Depending on which kind of exemption the seller has, he may or may not be able to sale to civilian.Comment

It is because of PC32000(c)(1). A newly exempt LEO type can only sell guns they acquire using their newly exempt status, to another LEO.
It depends on exactly what type of LEO it is, and exactly how they got the gun in the first place. Like I said, most old school LE types, such as Sheriff, CHP, Police, Prison guards - they can still sell to whoever they want no matter how they acquired the gun. Other LE types such as DMV Investigator, Fire Marshall, Parole Officer - they cannot sell to whoever they want if they used their shiny new exemption to obtain the gun being sold.Notwithstanding Section 26825, a person licensed pursuant to Sections 26700 to 26915, inclusive, shall not process the sale or transfer of an unsafe handgun between a person who has obtained an unsafe handgun pursuant to an exemption specified in paragraph (6) of subdivision (b) and a person who is not exempt from the requirements of this section.Last edited by SkyHawk; 02-21-2018, 6:25 PM.Comment
