The ATF letter says because the overall length is over 26", it's not classified as a pistol, handgun, or AOW. Does this mean you don't need to build it on a pistol lower? Is there a ca law I'm not thinking of?Comment

From my understanding you have to build this pistol kit on a lower that has already been registered or will be registered as a pistol. If you build it on a lower that has been registered as a rifle you are in violation of federal law for building a short barrel rifle with the pistol kit. You can be in violation of both state and federal law for just being in possession of the kit or any parts that allow you to build something illegal.
The time to register a lower receiver as a pistol expired last year with the end of SSE in Kali. Unless lower receivers are added to the Kali roster of approved handguns you will not be able to register it as a pistol lower. I doubt if that will be happening anytime soon.
There is an exception to all this, that is going down the 80% lower route. That lower you would not have to register however you would have to prove that you built it to be a pistol not a rifle. I have heard that people are documenting their build process to prove that they built it themselves and that they made a pistol out of it not a rifle. Kali and federal laws still apply such as using a tube or Sig arm brace instead of a butt stock and limiting the capacity to 10 rounds for magazines.
If you were to build a pistol legally with a 80% lower keep in mind that you also run the risk of being arrested by a LEO who does not know the finer points of the law. There is no downside for a LEO to arrest you and have the courts sort everything out later. The financial liability of lost work, bail, getting your firearm back, attending court dates, etc. are all on you. I would suggest you do some more research before purchasing this kit. A good place to start is on this website. There are a lot of folks with good advice. I am only speaking in generalities and do not claim to know the law in the detail you need. I understand about the ar pistol build, but I don't think this would be a pistol build. Just like you can register a "virgin" lower as a pistol or rifle (not in CA), couldn't you buy a stripped lower and build it as this "firearm" because it's not a pistol or rifle? A stripped lower is already listed as "other firearm" on the 4473 anyway.Comment
