Recently the standards and ‘due dilligance’ from some out of state with regards to some of the items coming into CA have started slipping somewhat and it has resulted in some serious problems:
Category 1 F’ups: Cheap Maglocks that are NOT legally sufficient
I’ve seen more of these than I really care to go into, as have a number of transfer dealers I’ve been in contact with. IF YOU CAN BEND THE LOCK OUT OF THE WAY WITH YOUR FINGER IT IS NOT! (let me be clear) NOT!!!!!! A mag lock… its just a useless, bit of tin on an assault weapon, which is going to get you in SERIOUS trouble!!!!
Improperly installed mag locks which don’t properly LOCK the mag in place…. Yeah, it’s a problem… there is no ‘close enough’ its either legal or its not, and if its not, then it’s a FELONY.
CHEAP CHEAP CHEAP *** homemade jumbopanda style locks which literally FALL OFF IN TRANSIT!!!!! Or if you’re lucky enough that they stay on the gun long enough for the transfer to be completed, then they FALL OFF WHILE YOU ARE OUT SHOOTING!!!! Seriously people, this is not a small issue… and cutting corners on this stuff puts you and your transfer dealer at serious risk of Felony prosecution. Everyone wants to make a mag lock these days. There are few good locks and many, many terrible locks on the market today.
Category 2 F’ups: Single shot pistols which are NOT exempt
Huge Huge HUGE problem recently. There are a lot of people who are getting into the single shot pistol market with absolutely ZERO idea of what they are doing… they are importing and selling pistols which do NOT have a sled (some are even so naive they are using empty magazines, which can hold multiple rounds and feed if you hold the gun upside-down. This is both a highcap mag issue AND a non exempt pistol transfer issue. Or they are pinning a sled in place without taking measurements to ensure that the pistol is dimensionally compliant. This is not a huge issue for the end consumer but it could land the transfer FFL in some serious hot water along with those 01 FFLs making single shot conversions and Saiga conversions whom are not licensed manufacturers.
Category 3 F’ups: Banned by name AW’s
This is a HUGE issue, during the last run of crazy production, a number of manufacturers managed to build guns which normally have OLL marked receivers with some that are NOT OLL marked. They are most definitely BANNED BY NAME AW’s. This is not a small problem, and just because you think the gun you bought on gun broker is ok, and the middle man you send it to is willing to break it down or install a bullet button on it and make it ‘CA legal’ doesn’t mean you are not setting up your friendly neighborhood transfer dealer up for some serious heartache. And if HE doesn’t do the due diligence to catch it then YOU are the one who gets to explain the felony that you take to the range with you.
Just because someone will SELL you something, doesn’t mean its LEGAL….. Some of these people are so desperate for money they’ll just send anything you want, and trust that its your *** on the line (or your dealers ***) if the item in question is not legal.
Category 4 F’ups: Illegal as hell NFA items…
i.e. “I got a screaming deal on this open bolt gun that just has a teeny weenie problem that the seller didn’t tell me about and my dealer and middleman didn’t check it when they transferred it through. So the first time I go to the range I get to experience what its like to shoot an illegal full auto weapon in public.”
or… I got this great 14.5 inch M4 carbine clone with a not so pinned flash hider… and now I have an SBR
or… The barrel extension came ‘loose’ in transit and now your cheap MP5 clone is an SBR.
or… this ‘vintage’ CAR upper has a REAL Vietnam era moderator/flash hider on it… or as CA/the feds would call it… a SILENCER…. It doesn’t matter if its ‘pinned and welded’ in place…
or… The redneck home cut down shotgun that I bought was not properly measured by the jerk that cut it so its 17.9 inches long instead of 18 inch barrel like it was advertised as and now I don't even realize I have an SBS.
or… The seller decides that “I’m throwing in a forward handgrip for your AR pistol, Intratec DC9 ak etc… and I’m going to ship it in the same box… and while I’m at it I’ll just be a nice guy and mount it to your pistol for you to save you the time”
Category 5 F’ups: Pinned 10 round mags that ARE NOT 10 rounds….
I don’t know where these mags are coming from… but there have been a number of instances where people have been getting 10/30’s or 10 rounders that hold more than 10 rounds REMEMBER people if the fixed mag on your rifle holds more than 10 rounds it is an ASSAULT weapon. It doesn’t matter what features it does/doesn’t have. This goes for all pistols and rifles and YES you need to make sure that the mag in the gun is for the round the upper chambers this can be an issue, particularly with some 6.8 mags that are kicking around out there that people seem to be matching with 5.56 guns.
Because of all these problems that keep cropping up and dealers and gun owners have been calling to ask my advice and in some circumstances assistance in correcting the problem, Freakshow Manufacturing is now offering a “CA Compliance Verification Service”.
You have your vendor ship to us, a licensed 07 FFL Class 2 SOT, and we will check the firearm for:
• NFA Violations (SBS/SBR/Machine gun/Silencer/AOW/Constructive Possession
• Banned By Name Assault Weapon Status
• Illegally configured Assault Weapon Status
• Defective Maglock Assault Weapon Status
• Defective Magazine that will trigger AW Status when installed.
We provide a buffer between the CA receiving FFL and the Vendor who is sending you the "CA legal" firearm in question. We will NOT ship an ‘accidental’ assault weapon to CA. Since July 1, 2008 Freakshow Manufacturing has shipped in excess of 3,000 firearms in California legal configuration for both retail customers and FFL dealer clients. We are one of the most experienced middle man companies in the business.
The Cost for you not causing a bunch of people (including yourself) to risk incurring a felony and loss of their licenses/permits/business/livelihood is a whopping $25 and it includes shipping.
IF we find a problem which can be rectified, all the additional expense you will incur is the cost of any materials (i.e. a non defective maglock) needed to resolve the problem, the labor involved is covered as part of the compliance inspection process.
If a banned by name AW DOES show up, we also offer a “make this thing go away” service, whereby we will list the firearm for you on Gunbroker for cost plus a flat fee. We will list the gun, handle any auction communication, receive payment & ship to buyer, then forward payment to you, minus the fee for our service. We will also list the weapon on our website for no additional charge. Surprisingly enough, we get at least a dozen calls a month from panicked FFL dealers asking if we can take an AW off their hands so they aren't in violation.
If an NFA item shows up, or is created in transit (I’ve seen it happen as a result of poor packaging and rough handling) we will discuss the options you have depending on the exact circumstances and the type of gun/configuration/nature of the NFA item. Some things can be fixed, some have to have the receivers destroyed etc. You will not be responsible for any additional disposal fees, but, depending on the circumstance, you may have to forfeit all (or part) of the firearm to the boys at the BATFE. If we have the legal option to repair the item you may be able to pay a small gunsmithing fee to fix the issue. We get some leeway as an 02 SOT with regard to how we have to deal with some things (repairing malfunctioning/broken firearms). We will discuss with you any issues of this nature and inform you of your options and any fees involved.
There is NO reason for transfer FFL’s in CA to be exposed to the amount of issues/risks that they are currently facing.
So… that’s my combination Rant/Service Offered post for the day.
Take advantage of it or don’t. It's your call, could be your butt on the line. $25 or hundreds on lawyer fees?
