Might also look for any laws that prohibit an unlicensed person from making firearms as well.
Also note there are differences between manufacturing and assembling in some laws.-POLICESTATE,

I could be wrong, but I don't think there is.Originally posted by WARDOGReal intelligent YUGO. That's how you get 3,421 posts in under a year?
But how about case law for those that have been through the ringer for possessing (without prohibition factors) a home-made firearm without a serial # and coming out on top. Case Law decision is your defense as long as the case is similar in circumstance.
We are so ingrained that we think laws tell us what is legal. They don't. They tell us what is illegal. So, based on 18usc921 there are descriptions of what a dealer is, what a manufacturer is, etc. If you are not making the firearm to sell then you are not a manufacturer and as such don't fall under the licensing, etc. It doesn't exempt you from 922r or being a prohibited person, etc. But, my understanding is that because you are an individual and making for yourself you can do it. Kind of like building a car for yourself, a dune buggy, a boat, etc.
Kind of like a bullet button or a monsterman grip or any of the other things we have come up with to allow us to own what we own. Nowhere in state law does it say a bullet button is legal. Very bright minds have worked to come up with solutions to keep us from doing something that is illegal.
I'm sure others will chime in as well and I hope someone corrects me and tells us what the specific law is.Last edited by Intimid8tor; 02-01-2012, 11:19 AM.Starve the beast, move to a free state.

This is a pretty old post to reference. I'm sure his views have changed since then. This was still back in 2006 and early AR ownership of off list ARs for many people.Originally posted by WARDOGHere ya go....I can't tell if is Gene Huffman or William M. Wiese Jr 2006
10. I want to build an operational AR-class lower from an 80% blank. This wouldn’t be on the list, so that’s legal, isn’t it?
No, no, no! Walk away from this - there’s too much chance this may not be legal. At best, it’s a murky situation.
The Harrott decision indeed protects off-list AR and AK series receivers. The problem is that there’s really no practicable way that homebuilt AR and AK receivers could ever be listed individually by “make and model”, and thus these may fall out from the scope of Harrott: the Harrott decision, after all, was all about practicality and uniformity.
If these receivers are not Harrott-protected, there’s a chance they could fall back under Kasler, making possession of such receivers a felony.
For now, you should only acquire off-list AR and/or AK series receivers from normal commercial production.
Also, let me ask this. What says a person CANT produce their own firearm for personal use??Comment

Old post
Laws only tell you what you cannot do.
Not what you can do.
No law prohibits the production by a person who can legally own a firearm from making one for their own use.
Be sure to comply with state local and federal laws when you do, and you're good.Comment

Fed Law: (is this from the AW Ban Era??)
With certain exceptions a firearm may be made by a nonlicensee provided it is not for sale and the maker is not prohibited from possessing firearms. However, a person is prohibited from making a semiautomatic assault weapon or assembling a nonsporting semiautomatic rifle or nonsporting shotgun from imported parts. In addition, the making of an NFA firearm requires a tax payment and approval by ATF. An application to make a machinegun will not be approved unless documentation is submitted showing that the firearm is being made for a federal or state agency. [18 U. S. C. 922( o), (r), (v), and 923, 27 CFR 178.39, 178.40, 178.41 and 179.105]

There is no law that says an unlicensed person cannot manufacture 1 or even 100 firearms for personal use. If your manufacturing for profit on a regular basis you need to have a license. If an at home builder plans to sell one of their builds, it must have the BATFE required markings. The name of manufacturer, city and state of where it was made, serial number, caliber, a minimum height of 1/16", and a minimum depth of .003".
Home builders can even make NFA firearms as long as the correct paperwork has been submitted and tax stamp is in hand.
The law only says what is not legal, everything else is legal. There are 3 kinds of people in this world.

No laws tell you what you are allowed to do, laws tell you what is illegal, so there is no answer to your question. I'd suggest starting here:
Then look up the relevant laws, specifically [18 U.S.C. 922(o) and (r), 26 U.S.C. 5822, 27 CFR 478.39, 479.62 and 479.105]Last edited by Yemff; 02-01-2012, 2:13 PM.Charlie don't surf!Comment

A complete lower with a standard mag catch isn't an aw until you mate a complete upper.chambered in a centerfire caliber with that lower.Originally posted by WARDOGThanks to all that have INTELLIGENTLY responded to this topic.
As far as making an Assault Weapon per Kal. laws, It could be scary.
I wonder if DOJ would go so far as to ask if my "Bullet Button" was already installed before I finished machining the fire control pocket. Or in what order it was machined. Of course they would have to prove otherwise, and they wouldn't get any answer from me.
If it was machined completely, and then the bullet button was installed, there may be a short time where it could have accepted a large capacity magazine, wether there was a mag catch installed or not.
Luckily, I installed my "Bullet Button" before I finished machining it.
