    Fiocchi 55grn .223 defective. Update! Resolved!

    I made a thread a while ago (In the wrong section I admit because I didn't notice the ammo/reloading board) about 300 rounds of Fiocchi .223 I bought from Midway.
    Every single round is seated off-center. I detected it by rolling the cartridges across a counter (you can see the tip move in a circle). So I called Midway.
    They said they don't take returns on ammo. I said it was defective. They they said sure ship it back. Then I call up UPS and ask how I'd go about shipping ammo back to the distributor. They said they can't ship it citing something about it being illegal to return ammo to a distributor. I call back to Midway, they say that if I can't ship it back they won't refund me and they passed the buck to Fiocchi. Fiocchi's site has been under construction for months so it wasn't very helpful. The only phone number got me to an machine that asked me to leave a message. I did. It's been almost a month and there's still not a peep from Fiocchi. Then I called my bank to file a dispute, they said that because Midway was technically willing to refund me (even under impossible circumstances) there was nothing they could do.
    I think I might want to try leaving Fiocchi another message in case the first got erased by accident or something. But as it's looking now I'm 110$ in the hole and this whole runaround has gotten me absolutely nowhere.
    So if you're thinking of buying Fiocchi Shooting Dynamics 55grn .223 either avoid it like the plague or if you're buying in person inspect it first.

    Does anyone know any phone numbers of Fiocchi representatives?
    What do I do with 300 rounds of ammo that I can't shoot or get my money back for?
    Is there some way to get them pulled and re-seated?
    Does anyone want to buy it and scrap it for it's components?

    Update: After many e-mails back and forth and many problems with the shipping arrangements the matter has finally been resolved! My ammo was not only replaced, but upgraded from the 6 boxes of regular 55grn. .223 that I sent back to 7 boxes of 50grn. V-Max! Fiocchi more than made good on their word to stand behind their product, their representative went out of his way to resolve the matter and upgraded my ammo to a better loading to boot. I'm very satisfied!

    BS. Box it up, put on a hazmat ORM-D label and then take it to a UPS customer center only. Ship back to Midway for refund, done.

      You want to return it because its got runout? Does it chamber? Does it shoot? Have you measured the runout?

        It chambers and shoots but jams, gets mile-wide groupings and I'm getting conflicting information about whether it is safe to fire or not. Some people are telling me it is perfectly safe. Some people are telling me that it will damage the barrel. Either way I didn't pay 100$ for ammo that shoots minute of Antarctica.

          You could also pull them and reseat. I would recommend a press mounted collet puller.

              Well, if you were inclined to start reloading there are many ways to go. One of the cheapest would be take a look at Lee equipment. Here's a kit that would have most of the things you would need besides dies:


              I'm just throwing the idea out there. As stated before, UPS will ship it if it is marked appropriately. So, there are other options for resolving this issue.

                See that's the problem I ran into. The UPS rep I talked to said that I can ship ammo but not back to the distributor, even if the distributor claims it is A-OK because the ammo is defective and it is not a regular return.

                You make a good point though. I've always considered reloading and even though .223 isn't that expensive any money I can save is a good thing.

                  You can do this to start for minimal expense.




                  But I would still send it back to Midway. UPS doesn't know they're the vendor. Throw an "ORM-D" sticker and ship it off.

                    You can save money...but you can also make better, more reliable and consistent ammo than you can buy at that price.

                    At the very least, start saving your brass. Also, pick up a copy of Lyman's 49th reloading manual. It's a good place to start.

                      sounds like BS to me. SO, you can ship ammo anywhere in the US except to the distributor. Tell them to show you the law. Pretty sure it doesn't exist. If they can't show you the law, I'd box it up and just send it off iwth the proper markings. How would the UPS rep know it was returned ammo.

                      I've never seen a law that says you can't return ammo. AFAIK, it is just a liability issue that most vendors don't want to accept returned ammo to resell it since they don't know if the ammo was tampered with.

                        Good News

                        After calling Fiocchi a second time I got a response the next day.
                        I suspect their automated system might have glitched and failed to record my message the first time 'round.
                        I'm going to see if I can get a different response out of UPS since it looks like the info the last representative gave me can't possibly be accurate.

                        Please tell me the item # from the ammo (I think the message said 223 55 grain, so fmj’s would be 223A-it will be marked on the outside of the box end flap). Please also tell me the lot number (stamped on the inside of the box end flap, 9-10 digits black ink). I think you said 300 rounds, so 6 boxes if that is correct.

                        UPS can and does ship ammo. I can have a UPS or FedEx call tag emailed to you (which ever is more convenient for you). The call tag will have your return address and my address for ship to, and it will bill me for the freight.

                        I will have to look into shipping ammo back to you under CA law. If nothing else, please include a scan or copy of your receipt and I will get you a refund.
