I think it's legal to take it down. I would take my SG and get it done. The question is what to do if it flies very high... pullet should stay on your property. But the real question is, why is someone flying over your property! You may chase the drone and track the operator down.

Tell me would you be as upset if it was a remote-controlled fixed wing aircraft? I think not, mention the word drone and everybody loses their f@#%ing minds. 90% of drones you see flying around do not have cameras capable of zooming in on you or even seeing you standing in your backyard. They would have to literally hover 10 feet from you to be able to read the stupid saying on your T-shirt.

I've had a Drone for about a year now and going to be taking the FAA 107 test soon (remote pilot license) I have had people come up to me and ask if I was filming their private property. As soon as they see what it looks like they calm down. As said most people have this assumption that I can be 400 feet up and 1000x zoom.

As said shooting a drone out of the air has more repercussions that shooting your neighbors loud motorcycle while hes warming it up. Find the owner and ask him/her to be more respectful.
