I am building a 308 from an 80%. I would like to know if I can build a 12.5 inch upper and use the Sig Brace as a pistol and also build a 16" upper and go back and forth as I see fit.

no you can not go back and forth from pistol to rifle back to pistol in CA
you can go pistol to rifle but once you do its a rifle from there on in the eyes of CADOJ

ATF also has a letter out that if you shoulder a sig brace it will become a SBR , also illegal to mere mortals in CA

Sure about that? I believe that the ATFE letter you refer to applies to the Black Ace Tactical shotgun, not to Sig braces in general. If you have a different letter or information leading directly to it (no second/third/nineteenth hand or gunshop FUD, thank you) kindly post it up.

Gotcha. I saw that thing on the sig brace, may or may not be illegal still. However, I think they are going to be soon.
There's no way of telling if it's a pistol or rifle on an 80% because it has no serial number, correct?

There's a new BATFE FTB director and he is issuing new determination letters that are reversing the previous letters concerning arm brace and use.

Under the current BATFE FTB director...
Arm brace installed on a Title 1 Handgun or Title 1 Other = legal.
Arm brace installed on a Title 1 Handgun or Title 1 Other and used as designed (strapped to forearm of shooting hand) = legal.
Arm brace installed on Title 1 Handgun or Title 1 Other and shouldered = illegal SBR/SBS.
