    Moving back to CA

    Hello all,

    I am moving back to CA from Kentucky. I have purchased a few rifles here that I plan on bringing back. I don't know if I will have time to buy bullet buttons. Will I stay legal if I separate the upper and lowers receivers?

    Depends if the lowers are off list. If they are then your good to go by separating them.

        I think that's too facile.

        Technically a lower without an upper is neither center fire nor semi-automatic. Certainly, much of the law addresses technicalities.

        But possession of a centerfire semi-automatic upper and an off-list lower without a magazine locking device such as a bullet button might be taken as a 'dissassembled assault weapon'.

        If prosecuted, might take many thousand$$$ to defend - and no guarantee of winning.

        'Bullet buttons', in contrast, seem to be about $20 each.

                Don't forget...

                After you re-establish residency in CA (obtain a CA DL), you have 60 days to register all the firearms you bring with you to CA.

                You can do this by sending in a completed New Resident Firearm Ownership Report to CA DOJ BOF.

                  If worse comes to worse, can he not break the lower down to its core components (i.e., remove pistol grip, buffer tube) to remove the 'evil' feature and render it inoperable? Perhaps remove the mag release, so that it will not even hold a magazine?

                        What do you suppose such would accomplish?

                        The serialized lower (we seem to be talking about AR-types here) is still a firearm, and would still need to be registered. Broken down to a bare off-list lower might make it more difficult to argue it could be a part of an illegal 'assault weapon' in combination with an upper.

                        A 'bullet-button' would be a lot less work, and less subject to interpretation.
