    Mag Capacities

Q: If I have a .40 caliber, 10 rnd mag and it fits and functions with the same brand pistol in 9mm which will hold 13 rnds. Am I breaking any law since its a 10 rnd mag?

( It has been brought up on another website and has been commented on being reliable and functions flawlessly.)

If you have a HK USP compact 9mm you can use the USP compact .40 cal mags and load them with 13 rnds. Since 10rnd 40 mags are about 10.00 vs 25.00 for a 13rnd 9mm

Don't care about the reliability concerns. Just Ca law.

    10 rounds = good.
    10+ rounds = bad.

If you bought the magazines legally as 10-rounders, and you don't modify them, then it appears you haven't broken any laws.

CA restricts sale and transfer and manufacture. It does not restrict use, except as a complication in the OLL/AW arena.

I could imagine DOJ having a word with H&K about it, but don't see that H&K is doing anything wrong selling 10-round .40 cal magazines, either.

I wouldn't go around advertising info like that or get caught using a mag thats marked for a different caliber than your shooting.

why? do you feel inserting 9mm into a 40 mag would be manufacturing or am I missing something?????

Nope not at all,but a DA could maybe see that as a way of skirting the law. I don't care either way just be carefull doing somthing like that.
