Pistol transfer question..

    Pistol transfer question..

    My friend wants to get a pistol from his uncle. The pistol was orginally owned by my friend's dad who passed away years ago. The uncle has simply been holding onto the pistol for all this time.

    How should he go about taking possesion of the gun from the uncle so that everything's Kosher? I'd imagine him and the uncle could go to a FFL and have the FFL hold onto for 10 days?

    Well, while your friend's dad was still alive, he could have just handed him the gun and that would have been a legal transfer. Maybe he did give him the gun all that time ago and forgot about it...

    Otherwise, the "safest" option is to go through the trouble of going to a gun store and doing a PPT which costs 35 bucks and and the buyer needs to have an HSC card, proof of residence that matches the ID he uses...(same as any handgun purchase).

      If I give a gun to my Dad, does he need anything like the HSC card? I didn't think so, which is my one of my 1911s is in my dad's safe and not mine. Or am I breaking some law in the process?

        You can "infrequently" loan it to him for a period of up to 30 days if he has an HSC card. I believe CalDOJ defines "infrequent" as up to six times per year for handguns. So that would cover about 6 months.

        You can transfer it to him if he has an HSC card and you send in the Intra-Familial Handgun Transfer form along with $19 to CalDOJ.

        Either way, he needs an HSC.

          He needs an HSC, unless he is exempt.

            Since his dad owned it and the uncle was just holding it and had no record of transfer- i would just give it to the kid-

            There will be no question and technically not 100% lto the letter of the law- it could not be questioned since the uncle had no record of having it and you do not hold the burden of proof to prove when his dad gave it to him.
