Safe Affidavit

So I am getting ready to go to my LGS to pick up my lower that I bought when I noticed they charged me $7 for a gun lock. I called them and asked if I could get my money back if I bring in a safe affidavit. They told me that they don't take the affidavit and all guns that leave the shop require a lock. Is this an option for guns shops?

It could be their in house policy. If it is, there's not much you can do about it except not shop there anymore and let them know the reason why. I'm sure the money they made off that $7 lock will offset the potential profit they will be loosing from the lack of your repeat business. Again, after you get your lower, let them know that you won't be setting foot inside their shop again and will spread the word that you don't like their policies.

Could they provide proof? It's been about two weeks since I picked up a firearm from a FFL and the safe affidavit worked fine then.

It just hurts do that. This is the best shop within 40 miles or so.

So my take away; his pov as an FFL was 'yes' there was an actual requirement... despite him not trying to sell me the lock (I had plenty of time.. a whole 10 days... to get my own lock on amazon). I'll add; I didn't 'feel' any sales-ness. Zero push or guiding me to buying the lock from him.

Buy a lock, walk out with your new toy, come back in and get a refund for the lock.

For handguns, Federal law requires that it leave the shop with a lock. No receipt is required. For state law, either a safe affidavit or a lock with a receipt dated within the last 30 days is required. So, a safe affidavit and a lock without a receipt will satisfy both Federal and state laws. However, many FFLs simply are not bright enough to comprehend this and, instead simplify it so that a lock has to be purchased within 30 days period. That's the easiest way to satisfy both Federal and state law and the simplest for them to understand.

For non handguns, a safe affidavit or a lock purchased within the last 30 days is all that's required.

Last time I DROS'ed a long gun (lower), my lgs just told me to take note of the make and model of my safe come time for me to pick it up. Didn't require a lock as long as I have a safe.

So I just got home with my lower. Their policy is with lowers it can be made into a pistol so they are covering their butts because they have no control over how I am going to configure it. With how things are done here in CA I can't blame them.

Then a safe affidavit and a lock without a receipt would have satisfied both state and Federal requirements. There was no legal reason to sell you a lock except for their story policy.

Wasn't the lower DROS'd/registered as a long gun? How is it their responsibility if you make it into an illegally configured gun?

I could buy a complete AR, go home and change the stock/buffer tube for a pistol tube and put a short barreled upper on it and have a pistol. Illegal as hell, but I could do it. Should they make me buy a lock because of that possibility? They're just padding their profit margin by requiring the lock purchase.
