Need some DROS pick up help for my girlfriend

Long story short, my girlfriend purchased her first AR lower 11 days ago from Rifle Gear and we went to pick it up Yesterday after work together. Her DL expired 5 days after they started the DROS. I didnt think that would be an issue being the DL only needed to be current during paper work and day of purchase especially when they didn't say anything on the day of purchase about it expiring before the 10 days was up.

She has a passport but its her maiden name but she put her married name on the papers being she is finalizing her divorce and its final in August of this year but her new DL will not show up until her name is finalized and already paid for.

So what can we do or use to show ID for DROS pick up? She's been bummed out as we all would be and doesn't want to pay another $25 to reDROS and wait again cause her DL expired 4 days ago... Technically she still is under the name of her expired DL but because its 2 days expired they wouldn't let her take the lower home.

She went to the DMV today to just buy a DL with her old name even tho her new one is alreayd paid for just to get it and avoid the reDROS but the machine was down and it takes 2 weeks to be mailed to the house missing the 30 day reDROS.

Anyone have any other ideas on how she can get the lower legally as a form of ID? Is the expired DL nt applicable for pick up? Again I thought as long as it was current during purchase for the DROS check was all, it being irrelevant for pick up since she cleared the background and had a valid DL during the check? No?

Wow I've never shown ID or papers on pickup. Try going back and talking to someone else. Just hand them your receipt and say "pickup!"

If that doesn't work then hopefully her new DL will be in the mailbox before the end of 30 days.

Expired is expired. I would wait until you get the new ID and take both in and talk to the manager and explain the situation. Bring a bill with the address and same name just to show that she is who she says she is. If it were my shop I'd make copys of all IDs and call it good but I'm not a complete dick either.

Yea they were super cool about it and tried working with us but said like you expired is expired. We asked about utility, car reg even her passport and ID next to each other to show it's her just a different last name again due to the pendig divorce. Still said no go it has to be a current DL with her married name which she used on the papers and matched her DL which is now again 3 days expired.

I said the same thing I usually bring my paper work and it's a done deal. Reason I told her and assumed it expiring before her pick up wasn't an issue being it was valid during DROS. Only time ive ever needed my ID. They said something about it passes CA code but not federal code to pick up wih an expired DL/ID.

Can you get a printout from DMV indicating license is valid with new DL dates. That way she can show her license is valid and no longer expired. Cross reference the DL# to the expired card just for the picture. Just a thought. Rifle gear can take copies of both for their records.

The last 5 firearms I've bought I've been asked for 2 forms of ID. This is for pickup.
Yes I took the pic, no I didn't go swimming!

^^^^^ This should work. Just get a DMV temporary DL printout.

You cannot purchase a firearm unless you also purchase and maintain a current, non-expired, government issued identification card.

I'm pretty sure that's right there in the US Constitution, right?

                    That's right.

It's mentioned right after the Constitutional Ten Day Wait, and right before the One in Thirty Days Clause.

You know, on my last purchase, I waited until my new license was in hand before starting the DROS. It's less complicated that way.
I learned that from reading all these, "My license is expired" threads.
Sorry, I know it doesn't help the situation.

The license itself is not expired, the card it's currently printed on is expired, my opinion would be showing the dmv printout, is sufficient proof, that the license itself, is not expired. The proof of validity was made at purchase, and, considering DOJ did not reject it, suggests they show it having been valid

Yes you have. You need to show ID again to make sure the person who DROSed the firearm is the person who is walking out the store with it.

OP, Calguns is a good place to ask, but unlike with most gun stores, if there was an easy solution the guys at RifleGear would probably have known what to do. They are really on top of the law.

I have seen them accept DMV printouts to verify, for example, drivers licenses that had an incorrect address.

This is what I was going to suggest. Go to the DMV and renew her license if needed. Then get a copy of her DMV printout with current address and provide it to the FFL. This should count as a government issued form of ID. I've used it as a second form of ID when buying pistols before when they insisted the address on my license be current (was told the brown change of address card didn't count).
