    chinese SKS

Have a friend who wants to sell me a original Norinco SKS. No bayonet on it but it has a fixed 20 rd mag with a Chinese star on the magazine body. It is in perfect condition.
He wants $300 for it which seems good.

The question is are these fixed 20 rd mags on a SKS Calif. Legal or do we need to switch it to a fixed 10 rd before doing the FFL transfer.

Semi-auto centerfire rifle with a fixed magazine capacity of more than 10 rounds is considered an assault weapon. [PC 30515(a)(2)]

If it is not a Registered Assault Weapon (RAW), then mere possession is a felony.

In order to be legal in CA, the fixed 20 round magazine needs to be removed and replaced with a 10 or less round fixed magazine.

If it is a RAW, then it also needs to be de-registered prior to transfer.

      Penal Code 30515
      (a) Notwithstanding Section 30510, "assault weapon" also means any of the following:
      (1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
      (A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
      (B) A thumbhole stock.
      (C) A folding or telescoping stock.
      (D) A grenade launcher or flare launcher.
      (E) A flash suppressor.
      (F) A forward pistol grip.
      (2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
      (3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.

you & him take it off, then do the transfer (with no mag in the gun).Sell off the 20 rounder and buy an original 10..and shoot hapily ever after...$300s a good buy for a decent chi-com

          SKS

Thats what I thought. Going to have to get a 10 rd clip and give it to him to switch it. Then do the deal. I thought the price was good.

          Thanks all.
