    Recovering a Stolen Firearm

Any one have any experience recovering a stolen firearm. I had 2 firearms stolen in 2006. I received a phone call from the Highway Patrol 2 weeks ago letting me know they recovered one of my weapons. I went to pull the original police report from the burglary but was told that they had "misplaced" the report and the officer assigned to the case has not returned any of my calls. The Highway Patrol is telling me that the weapon might not be returned and isnt being terribly helpful in telling me what I need to do to get the property back.

Anyone have any experience in this area? Any suggestions?

    Thanks

      Stolen weapon

I had a weapon stolen some years back and it was recovered. Not a complicated process. CHP has probably already notified the local agency of the recovery. Contact the CHP field office and ask to speak with the watch commander regarding the comment about you not being able to recover the weapon. It could be something like the suspect in the CHP case and your theft case has a bigger picture (other cases/thefts).

I don't know the size of your local agency you reported the crime to, but I know I have waited weeks for an officer to contact me regarding all sorts of issues. Some were at a school/training, vacation, injury leave & etc. Either way ask to speak to your local agency's Watch Commander or sgt, or property crime detectives.

Since you were a victim you should be able to get weapon back.

It took me a year, and beaucoup phone calls / emails to get two rifles back after they were recovered.

One thing to keep in mind: if you were reimbursed by your insurance company for a stolen fiream, I believe that gun is the insurance company's property if it is recovered. You'll probably have to talk with your agent about purchasing it back from them.

With my homeowner's insurance (CSAAA), they said they would notify me if my stolen handgun was recovered and offer me the option of purchasing it back. If I elected not to, they would ask the PD to destroy it for liability reasons.

Mine was real simple. The det that handled my case called me to pick up my Glock. Went to the Antioch police office picked it up. the only thing I did'nt get back was the black Talon .40.

I actually had a Sacramento PD officer knock on my door and asked me who I was. They didn't ask if I was so and so. After identifying myself and showing my DL, they said that San mateo PD had recovered my Colt Gov't. SS .38 Super.

They gave me the name of the officer/detective in San Mateo. I called them up and they shipped it to Sacramento PD property room. Went down, showed my ID and picked it up.

Total was 5 days from the knock on the door. Oh, the gun was stolen 7 years before.

I bet know you may need to do a LEGR.

after the case is settled, if they made an arrest, u will have to fill out a DOJ form, CHP can advise which one, may cost 10 or 15 bucks to do, DOJ will prove ownership, then u r able to recover the gun. All u should have to do is prove ownership once the case is settled in court and they can release it to u. U should definetly go to the CHP office and talk with someone who knows what is going on. Depending on where u live, may have been a new CHP officer that doesnt know u can get ur gun back.

They won't release the firearm till they have closed the case since the weapon is evidence.
