    SVT 40 or Russian SKS

So I am looking to buy either one but preferably the SVT 40, the only problem is... ever where I go GS can not decide if it is legal or illegal. Both are original refurbished rifles and both are complete and the same as when they were refurbished. Are they Legal or is it now illegal after 1 Jan 2014? One of the SVT40 is in California already so....... shouldn't it be legal for transfer?

if it has a flash hider or grenade launcher its illegal. if it does not have either of those its legal. i remember seeing a SVT at my local gun store once. even if it is C&R i think it still needs to go through a FFL and get registered like any other long gun now. SVT's are expensive here though, the SKS will be cheaper to buy and shoot.

I am not too worried about the expense, working on the WWII collection. As long as it is legal in California, is the big issue. The Russian SKS its still Milsurp and I would love to have it for the Russian Collection.

The Russian SVT-40 and SKS are both CA legal and are both considered C&R firearms.

Unless you have a valid (C&R) Type 03-FFL and valid COE, the firearms needs to be transferred through a CA FFL dealer.

            Tough call
How being that said it's going to depend on your budget; a SVT-40 is going to cost you around $1200 and a Russian SKS is around $800.

When I bought my SVT-40 a couple months ago I found a couple of good deals on gunbroker but the sellers would not ship to California. When I found one that was in good shape and the seller willing to ship to California I ended up going over my budget by $200. If the SVT-40 is already here, in good shape and you got the dough, go for it.

I would gladly trade my Russian SKS (which I love), for an SVT-40. No contest in my book.

Now I want a SVT, wouldn't really be able to shoot it, but I want it!

So far as Russians go, I'd much rather have an SVT-40, but I'd shoot the SKS much more often.
I know this because I own both.

                      Update on SVT 40

So as Eddie1965 said, no dealer will do the transfer because they think it is illegal. I called DOJ but have not got a response. and yes the guy would not ship it because he said it had a flash hider instead of a mussel brake. Oh well his loss and mine.

For future reference, here is the US Army Ordnance Corps MANUAL FOR THE SOVIET TOKAROV. It clearly shows and describes the offending item as a Muzzle Brake.
