    The FFL must document the return to the seller in the A&D book. Unless the State provides the FFL with proof the seller has been background checked, the FFL must do a new DROS to comply with Federal Law.

      When a buyer is denied in a PPT a DROS is automatically run on the seller and if the seller passes the FFL receives a deny letter for the buyer and a release letter for the seller. Otherwise they are directed to turn the firearm in to law enforcement for destruction.

        BTW, a 4473 has to be filled out for the seller to get the firearm back due to Federal law. The NICS number to be used is the original DROS number of the PPT. There is no waiting period. As said, the seller undergoes a background check when the buyer is denied.

          You should get your property back as the 01 is not a law enforcement agency (Sheriff to be exact). Unless they will compensate you for your loss then you have a clear cut case of a 5th amendment constitutional violation!

              That would be true if the FFL was a government agency. A private business cannot violate the 5th Amendment.

                    Sheriff's (dully ELECTED have standing (and ONLY Sheriff's, not 01 dealers), city police (AKA city security guards don't either). Sorry to burst your bubble but like Larry Potterfield says "that's the way it is"!!!!.
