    old rifles with deceased owner

I have a good good question. My bro in law has 2 old rifles that were his father's. His father passed away and e has possession of these rifles. It as been about 15 years now. He wants to sell them but doesn't know what he has to do or if there is anything he has to do before he can sell to a buyer. Any thoughts on this fellow Calgunners?

Thanks and I appreciate any info.

Found out what the rifles are.

    Mauser Chileno Modelo 1895

    Marlin Est 1870 Model 336

A father can give rifles to a kid without paperwork or reporting. Unless they have been reported stolen there is no problem with son selling them.

Older than 50 yers you can sell them to any ca resident over 18 with ca id no ffl involved. Called curio and relic sale. Can even ship usps to them after they send you ca id and statement that they are not a prohibited person.

But only until the first of the year! So if he's going to do that, he needs to get going with it.

There are collectable and then there are collectables.

Well I believe these are from from early 1900s. Possibly late 1800s. I'll find out tonight

Well, if they were made before 1898 and you can prove it via serial number or whatever they're not curio and relic... they're antiques and you can do all kinds of fun things with them, like sell them across state lines to somebody without any kind of FFL. Antiques that are in shootable condition tend to command a premium so it would be worth researching if there's any shot at that.

I I have the rifles in my possession and I don't think they are from the 1800s. Maybe they're just part of the models. Here are the rifles. Don't know much about them.
